The meeting of the Planning and Zoning Commission was called to order at 5:30 p.m. by Chad Lindsey. Commissioners Present: Francine Neeley, Chad Lindsey, Clifton Fendley, Austin Anthony, and Tylesha Ross. Absent: Sims Norment, Cody Adams City Staff. Carla Easton, City Engineer; Stephanie Harris, City Attorney; Steve Clifford, City Council Liaison/Mayor 2. Citizen's forum (Unless an item isposted on the Agenda, the Texas Open Meetings Actprohibits the Commission from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personal appeals are not appropriate for citizens' forum) Citizen's forum was declared open. With no one speaking, the citizen's forum was declared closed. 3. Approval of minutes from the meeting of August 3, 2020. A Motion to approve the minutes for the August 3, 2020 meeting was made by Austin Anthony, seconded by Tylesha Ross. Motion carried 5-0. 4. Public hearing to consider and take action regarding the petition of Rene Harvey & Russell Lowe for a change in zoning from a One -Family Dwelling District No. 2 (SF -2) to a Commercial District (C), in the City of Paris, Block 331, Lot 7-A & PT of 8, LCAD 18889, located at 3 78 7 NW Loop 286. Carla Easton states Rene Harvey is requesting a zoning change in order to allow a commercial office use. Without a change in zoning, the existing building cannot be used for anything other than single family residential, which is not appropriate for the existing structure. Staff is not opposed to this zoning change, as it is consistent with the comprehensive plan and could provide an opportunity for occupancy of a currently vacant building. The public hearing was declared open. The following spoke in favor this petition: Rene Harvey, 4125 Smallwood Vic Ressler, local realtor The public hearing was declared closed. A Motion was made to approve this item by Clifton Fendley, seconded by Austin Anthony. Motion carried 5-0. 5. Public hearing to consider and take action regarding the petition of Skyler Burchinal for a change in zoning from an Agricultural District (A) to a Neighborhood Service District (NS), in the City of Paris, Block 329, Lot 5B, LCAD 18881, located in the 3800 Block of SW Loop 286. Easton states that existing land uses in the area include single family residential to the north and west, with a church directly south and highway frontage on the east. The proposed development is for offices along the frontage with medium density residential in the rear of the lot. Utilities are not currently available to the lot; therefore, extension of both water and sewer will be required with platting and construction process. Access will require a new driveway onto Loop 286, which will ultimately require TX DOT approval. Staff supports this zoning change request, as it is consistent with the comprehensive plan and the proposed development does not pose a disruption to the surrounding land uses. Public hearing was declared open. Skyler Burchinal, 132 CR 3310, Brookston, TX spoke in favor this item. Gary Bridgers, 4010 Sage Trail, spoke in opposition of this item stating he would like to keep the neighborhood quiet. He states there is a lot of flooding to his neighbors and wants to know if development would increase flooding. Public hearing was declared closed. A Motion to approve this item was made by Clifton Fendley, seconded by Austin Anthony. Motion carried 5-0. 6. Public hearing to consider and take action regarding the petition of Christa Brown on behalf of Norman Montgomery Jr. for a change in zoning from a One -Family Dwelling District No. 2 (SF -2) to a Neighborhood Service District (NS), in the City of Paris, Block 294, Lot 11, LCAD 18507, located at 426 NE 30th. Easton states the proposed zoning change does not conform to the future land use plan, however, this use is not inconsistent with others in the near vicinity. The lot appears to be of adequate size to accommodate a mid-size building with appropriate parking. If approved, screening and buffering would be required along the south and east property lines due to adjacent residential uses. Public hearing was declared open. Christa Brown, 3330 W Kaufinan is the applicant. Browns states she has owned Super Tan for seven years and has outgrown her current space. She would like to construct a new salon at this location and asks that the commission approve this zoning change request. Skyler Burchinal, 132 CR 3310, Brookston, TX states he is the contractor for Christa Brown and they have looked all over the city to find a space that would service a neighborhood and this was the best location. Wayne Kirby, 390 NE 30th Street, states his property abuts the subject property and he has no objection to this item. Public hearing was declared closed. A motion to approve this item was made by Francine Neeley, seconded by Clifton Fendley. Motion carried 5-0. 7. Public hearing to consider and take action regarding the petition of Michael Davidson and Brian Scott for a change in zoning from a Two Family Dwelling District (2F) to a Four -Family Dwelling District (4F), in the City of Paris, Block 70-B, Lot 10, LCAD 14723, located at 1629 Pine Bluff. Easton states that Michael Davidson and Brian Scott are requesting 4F zoning in order to construct a quadplex. The proposed zoning change does not conform to the future land use plan; however, the existing zoning for the entire area is 2F so medium density residential is not far from what is already allowed outright. The lot appears to be of adequate size to accommodate a mid-size building with appropriate parking if oriented to face 17`' NE, which is across from an existing laundromat. Staff is in support of the zoning change request. Zoning input forms were returned with in three in favor and two opposed to this item. Public hearing is declared open. Brain Scott, 2830 Oak Creek, is the applicant and spoke in favor of this item. He states they considered constructing two duplexes and found it advantageous to combine the lots and build a quadplex. The benefit is the entrance and exit would be off 17th Street. Scott states this would be a premium product that would help to improve the area. The following spoke in opposition of this item stating issues such as traffic, noise, increased crime, drugs and concern for safety: Ms. Hayes, 1618 Pine Bluff William Smith, 1619 Pine Bluff Lynn Eggers, 348 NE 17th The following spoke in favor of the item: Skyler Burchinal, a local builder states the applicants are trying to build the neighborhoods up with premium structures with premium rent, which will improve the area. Public hearing declared closed. A motion to approve this item was made by Clifton Fendley, seconded by Austin Anthony. Motion carried 5-0. 8. Public hearing to consider and take action regarding the petition of Michael Davidson and Brian Scott for a change in zoning from a Two -Family Dwelling District (2F) to a Four -Family Dwelling District (4F), in the City of Paris, Block 70-B, Lot 11, LCAD 14724, located at 1639 Pine Bluff. Easton states this is the neighboring lot to item 7. The applicants intend to combine the two lots in order to build a quadplex. These properties have not yet been combined, therefore, presented as two separate zoning cases. As such, individual action has to be taken on each lot, and the development requires approval of both lots in order to proceed. Public hearing was declared open. With no one speaking, the public hearing was declared closed. A motion to approve this item was made by Clifton Fendley, seconded by Austin Anthony. Motion carried 5-0. R Consideration of and action on the Preliminary Plat of Lots 1, 2 and 3, Block A of the Church Street Bungalow 158-A Addition, LOAD Property ID 16573, located in the 1100 Block of Church Street. Easton states the owner has submitted a preliminary and final plat of the property providing for three lots. It appears that city water is available from a 2" main along Long Avenue, and a sewer extension will be required to serve lots 2 and 3 as part of the development. Each lot will have access to Long Avenue by separate driveways. It appears that the plat complies with the City of Paris subdivision regulations with the following revisions: 1. Provide side build lines of a minimum 5' from the property line on each lot. 2. Sewer service is not available to lots 2 and 3, and will be required as part of the development. A guarantee of construction will be required at time of permit. 3. Note that the lot depth was approved by variance to the ordinance on August 4, 2020 by the Zoning Board of Adjustment. A motion to approve this item with noted revisions was made by Chad Lindsey, seconded by Clifton Fendley. Motion carried 5-0. 10. Consideration of and action on the Final Plat of Lots 1, 2 and 3, Block A of the Church Street Bungalow 158-A Addition, LCAD Property ID 16573, located in the 1100 Block of Church Street. Easton states this is the same plat with same comments. A motion to approve this item with noted revisions was made by Chad Lindsey, seconded by Francine Neeley. Motion carried 5-0. 11. Review and discuss an amendment to the Zoning Ordinance regarding residential uses in General Retail and Commercial zoning districts. Easton states that City Council requested the P&Z Commission review and consider an amendment to the zoning ordinance that would allow residential uses in Commercial and General Retail zoning districts, specifically where the structures were originally built as residential homes. Three options were presented to the commission and direction was provided to staff to proceed with a draft ordinance. 12. Review and discuss an amendment to the Zoning Ordinance regarding a new definition for vehicle storage facilities, adding it as a land use, and determining the permissible zoning districts for this use. Easton states that staff was approached about a proposed development for a vehicle towing business with an onsite vehicle storage yard. These facilities are highly regulated by the Texas Department of Licensing and Regulations (TDLR), as well as Chapter 35 of the city ordinance. However, the most similar land use provided in the Zoning Ordinance is Wrecking/Salvage Yard, which is only allowed in Heavy Industrial zoning districts with a Specific Use Permit. A new land use is needed in order to differentiate between a vehicle storage lot and a wrecking yard. Easton presented a new land use for vehicle storage facilities for consideration. The commission discussed the use and provided direction for the draft ordinance. 13. Adjournment.
