13-15 - Local Amendments to the Building Code, Fire Code and Plumbing CodeItem Nos. 13-15
TO: Mayor & City Council
Grayson Path, City Manager
FROM: Carla Easton, PE, City Engineer
SUBJECT: BUILDING CODE UPDATES
DATE: October 12, 2020
BACKGROUND: In 2017, the city adopted the 2015 International Building Code (IBC),
Residential Code (IRC), Existing Building Code (IEBC), Fire Code (IFC), Plumbing Code (IPC),
Fuel Gas Code and the 2014 National Electrical Code (NEC), along with local amendments as
recommended by the North Central Texas Council of Governments. Some of the local
amendments added regulations to the base code in order to address certain life safety concerns for
emergency response times of a smaller fire department. Other amendments made the code more
regionally appropriate or consistent.
In 2019, the Chamber of Commerce developed an educational series for local contractors and
businesses to learn about building and fire codes. Many local contractors, builders, realtors, and
business professionals attended the meeting, and during the question and answer session, it was
asked if it would be possible to make the Code more appropriate for Paris. Direction was given to
staff to put together a committee to review the building and fire codes and make recommendations
to the city council regarding amendments.
STATUS OF ISSUE: City staff, with the help of Mark Lacey, assembled a seven member
committee to include a representative from each of the following disciplines: architect, structural
engineer, fire suppression engineer, master electrician, master plumber, builder and developer. An
introductory meeting with the committee and staff was held on November 7th, and each were given
a copy of the city code amendments for review. A citizens forum was held on November 14th in
the council chambers, where the committee received public comment regarding building code
concerns. Attached are notes from the open forum. A repeated concern was regarding consistent
enforcement, and very few specific code references were provided in the public hearing.
On November 21St, the committee met to review and discuss specific sections of the code that they
felt could or should be revised, and based on feedback at that meeting, staff developed a list of 9
specific code modifications for the committee to review. Another meeting was held on December
12th to further discuss the list of code modifications, which was reduced to the 6 items listed below
as a result of the discussion.
1. Interpretation of code, create a board of appeals for contractors to appeal code
interpretation by the building and fire code officials.
Both fire and building codes support this request.
2. Eliminate the verification by notary that the home was treated for termites.
3. Eliminate the local amendment requiring buildings over 6000 SF to have fire sprinklers.
Code minimum is based on construction type and use, typically 12,000 SF. The local
amendment was adopted due to the size of our fire department and available resources to
respond to fire.
4. Eliminate the local amendment that does not allow separation by fire walls to eliminate a
fire sprinkler system requirement.
Code minimum will allow a firewall as designed by chapter 706 to constitute a separate
building.
5. Add the following local amendment: The City Manager shall have the authority to waive
any local amendment after hearing both sides of the issue and making sound judgment
based on the information provided.
6. Accept the modifications to local amendments to the IBC, IRC and Plumbing code as
proposed by John Ankrum and Buddy Heuberger.
On February 10th, a voting ballot was emailed to each member of the committee for a final decision.
A tally of votes is attached for reference, and summarized here.
1. Passed 7-0
2. Passed 6-1
3. Passed 4-3
4. Passed 7-0
5. Tied 3-3
6. Passed 5-0
A final committee meeting was held on March 6, 2020, to review the votes, and no further
recommendations were made by the committee. Unfortunately, the COVID pandemic began in
March so these code changes were placed on hold for several months until the Council resumed
in-person meetings.
Because the city ordinance is organized in separate sections for building codes, fire codes, and
plumbing codes, this update will require three separate items on the agenda. Staff recommends
consideration and approval of all three amendments.
Also of note, a few opportunities for customer service improvements were identified and addressed
as part of this process. These included acceptance of electronic plan submittals for review,
commitment to a 10 -day turnaround time for plan reviews, and simplified application forms.
BUDGET: This ordinance has no direct fiscal impact. Resource materials will be made available
at the Community Development office and the Public Library upon approval of code changes.
RECOMMENDATION: Approve of revised local amendments to the adopted ICC codes as
recommended by the Building Code Review Committee.
