On July 27, 2020, the City Council approved an agreement with Gary and Rebecca Nash to partner
together in funding the installation of new gabion-style retaining walls in the drainage way behind
their property. The City had performed a sanitary sewer and erosion protection project in this area,
but at the time it was agreed that the Nash's sackrete wall would remain in place. The sackrete
wall subsequently failed. The Nash's and City came to an agreement to partner together to fund
the replacement of this wall. Bids were received and opened on October 1, 2020.
STATUS OF ISSUE:
A total of five (5) bids were received ranging from $56,985.00 to $88,500.00. The lowest bid
came from Bernal Commercial Construction for $56,985.00. Hayter Engineering has
recommended that the City Council award the bid to Bernal Commercial Construction and for City
Staff and Hayter Engineering to begin constructing the contractual documents.
BUDGET:
Per an agreement with Gary and Rebecca Nash, as well as a proposed amendment on your
agenda tonight, the City has agreed to spend no more than $25,000.00 on this project, to be
amended to $33,000.00 if the City Council approves of the amendment. Expenses would be for
both Bernal Commercial Construction as well as Hayter Engineering. The remaining amount
will be covered by Gary and Rebecca Nash. The total estimated cost for the project is
$68,260.00.
Side note, at the time of negotiation with Hayter Engineering for their services, the City had an
on -staff City Engineer who was going to perform some services not listed in the Hayter
Engineering contract in order to save expense. With Hayter Engineering identified to serve as the
Interim City Engineer (also on your agenda tonight), they will in fact serve in their contractual role
for this project as well as the City Engineer when necessary. The City Manager has agreed with
Mr. Nash that any City Engineer -related duties that were outside of the scope of Hayter
Engineering's contract will be covered and paid for by the City as they would have been our
expense with an in-house City Engineer, and therefore not charged under the Nash/City
Agreement. This would be above and beyond our Nash/City Agreement amount.
OPTIONS:
1. Accept and award the lowest bid of $56,985.00 to Bernal Commercial Construction.
2. Reject the bid and advise City Staff.
3. Request additional information.
RECOMMENDATION:
1. Accept and award the lowest bid of $56,985.00 to Bernal Commercial Construction.

Regarding the above referenced project, bids were received on October 1, 2020. Five bids were
received. All bids were opened and found to be responsive. Attached is the Bid Tabulation. The
low bidder is Bernal Commercial Construction Co. in the base bid amount of $56,985.00.
We have verified the completeness of the bid and have verified that the bonding company is
licensed in Texas. The bid appears to conform to the contract document requirements. Based on
a review of the Statement of Bidder's Qualifications, we believe them to be responsive and
responsible.
We therefore recommend award of this project to Bernal Commercial Construction Co. in the base
bid amount of $56,985.00. If the City concurs with this recommendation, please sign the attached
three original Notice of Award forms. Upon signing, please return all three originals to this office
for initiating the contract execution process.

1. Deliver to the Owner three [3I fully executed counterparts of the Contract Documents.
2. Deliver with the executed Contract Documents the Contract security [Bonds] as specified
in the Instructions to Bidders (Article 20), General Conditions (Paragraph 5.01), and
Supplementary Conditions (Paragraph SC -13.07).
Failure to comply with these conditions within the time specified will entitle Owner to consider you in
default, annul this Notice of Award, and declare your Bid security forfeited.
Within ten days after you comply with the above conditions, Owner will return to you one fully
executed counterpart of the Contract Documents.
