October 26, 2020
The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday,
October 26, 2020, at the City Council Chamber, 107 E. Kaufinan, Paris, Texas.
Present: Mayor: Steve Clifford
Council Members: Paula Portugal; Renae Stone; Gary Savage; Linda
Knox; and Clayton Pilgrim

Opening Agenda
1. Call meeting to order.
Mayor Clifford called the meeting to order at 5:30 p.m.
2. Invocation.
Finance Director Gene Anderson gave the invocation.
3. Pledge of Allegiance.
Council Member Portugal led the pledge.
4. Citizens' forum.
Carolyn Williams, 1601 1 Vh N.W. — she said her address had been changed and
complained about a fire truck going down the street with sirens when there was no emergency.
Consent Agenda
Mayor Clifford inquired of Council Members if they wished to pull any items from the
consent agenda for discussion. There being none, a Motion to approve the consent agenda was
made by Council Member Portugal, and seconded by Council Member Savage. Motion carried,
6 ayes — 0 nays.

5. Approve minutes from the meeting on October 12, 2020.
6. Receive reports and/or minutes from the following boards and commissions:
a. Paris -Lamar County Board of Health (7-20-2020)

7. Receive the September monthly financial report.
8. Receive September drainage report.

10. Approve the Replat of Lot 1, Block A of the AAA Mini Storage Addition, LCAD
Property ID 126622, located in the 1300 Block of NW Loop 286.
11. Approve the Final Plat of Lot 1, Block A of the 271 North Trailer City Block 306B
Addition, LCAD Property ID 109964, located in the 3500 Block of N. Main.
12. Approve RESOLUTION NO. 2020-048: A RESOLUTION REQUESTING THE
SHERIFF OR A CONSTABLE TO SELL TAX FORECLOSED PROPERTIES AND
TO RE -SELL BID -OFF TAX PROPERTIES IN ACCORDANCE WITH THE TEXAS
PROPERTY TAX CODE; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; PROVIDING FOR AN EFFECTIVE DATE.

13. Conduct a public hearing, discuss and act on ORDINANCE NO. 2020-054: AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS,
AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 253-
B, LOT 13, LOCATED AT 2126 E. POLK ST., FROM A SINGLE-FAMILY
DWELLING DISTRICT NO. 2 (SF -2) TO A TWO-FAMILY DWELLING DISTRICT
NO. 2 (2F); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING
MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY
CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
City Manager Grayson Path explained Steven Asay had demolished the dilapidated
structure on this property, and was asking for a zoning change so that he could build a new
duplex. He said existing zoning on the north side of E. Polk Street was already zoned 2F, and
the property directly south of 2126 was zoned 2F. Mr. Path also said the zoning change request
was not consistent with the comprehensive plan, but would allow a use that already existed in the

area. He said the Planning and Zoning Commission unanimously approved this zoning change,
and that staff recommended approval.
Mayor Clifford opened the public hearing and asked for anyone wishing to speak in
support or opposition of this zoning change, to please come forward. With no one speaking,
Mayor Clifford closed the public hearing.
A Motion to approve the zoning change was made by Council Member Knox and
seconded by Council Member Portugal. Motion carried, 6 ayes — 0 nays.
14. Conduct a public hearing, discuss and act on ORDINANCE NO. 2020-055: AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS,
AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 296,
PART OF LOT 9, LOCATED AT 3475 LAMAR AVE., FROM A SINGLE-FAMILY
DWELLING DISTRICT (SF -2) TO A GENERAL RETAIL DISTRICT (GR);
DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF
THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A
SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
Mr. Path explained the First Assembly of God Church was requesting a zoning change
for the western party of the property, in order to develop a new quick service drive-thru
restaurant. Mr. Path said the zoning change complies with the recommendations in the
comprehensive plan, that the Planning and Zoning Commission unanimously voted to approve
this zoning change, and staff recommended approval.
Mayor Clifford opened the public hearing and asked for anyone wishing to speak in
support or opposition of this zoning change, to please come forward. With no one speaking,
Mayor Clifford closed the public hearing.
A Motion to approve this item was made by Mayor Clifford and seconded by Council
Member Savage. Motion carried, 6 ayes — 0 nays.
15. Conduct a public hearing, discuss and act on ORDINANCE NO. 2020-056: AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS,
AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 259,
LOTS 16, 21, 33-A, LOCATED AT 650 N.E. 26TH, FROM A SINGLE-FAMILY
DWELLING DISTRICT (SF -2) TO A TWO-FAMILY DWELLING DISTRICT (2F);
DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF
THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A
SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.

Mr. Path said Skyler Burchinal was a requesting a zoning change for the purpose of
subdividing the property developing it as a residential street for single and two-family homes.
He also said that the Planning and Zoning Commission unanimously approved this zoning
change, and staff recommended approval.
Mayor Clifford opened the public hearing and asked for anyone wishing to speak in
support or opposition of this zoning change, to please come forward. Skyler Burchinal spoke in
support and said he was hired as the contractor. He said the owner wants to put in a street and
add on to 26th Street and come off 25th Street. He said they were going to work with the engineers
with regard to water retention, drainage, sewer and electrical lines,
Mr. Burchinal said the plan was for twenty-seven lots, which included multiple family
structures and to intermingle with some single-family dwellings. He said since the last meeting,
he met with the neighborhood and he, the owner, and the neighborhood had come to an
agreement. He said he would be building an eight foot privacy fence down their side to block
noise, he would have a set back off the fence line of fifty feet with regard has to how far to build,
that they agreed all of the residences would be single story and all of the materials would be
brick. Mr. Burchinal said they were trying to do their best to work with the neighborhood.
Kathy Jackson, 2540 Ridgeview, she said her property backs up to Skyler's and she
initially opposed the change but based on what he told them he was going to do, she no longer
opposed it. Donna James, 2620 Ridgeview, she said she was disappointed with the decision of
the Planning and Zoning Commission but after the meeting, Skyler met with the neighbors for an
hour. With what Skyler told them he was going to do, she said she was supportive. With no one
else speaking, Mayor Clifford closed the public hearing.
Council Member Stone said she appreciated Skyler in working with the community.
Council Member Knox commended Sklyer. Council Member Portugal said initially her
constituents were upset but after meeting with Skyler, they were happy and she was pleased with
him meeting with the neighbors. Council Member Savage said this was awesome.
A Motion to approve this item was made by Council Member Savage and seconded by
Council Members Portugal and Pilgrim. Motion carried, 6 ayes — 0 nays.
16. Conduct a public hearing, discuss and act on ORDINANCE NO. 2020-057: AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS,
AS HERETOFORE AMENDED, BY AMENDING SECTION 8, "USE OF LAND AND
BUILDINGS;" BY AMENDING SECTION 12, "SPECIFIC USE PERMITS;" BY
AMENDING SECTION 22, "GENERAL DEFINITIONS;" PROVIDING A REPEALER
CLAUSE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS
CLAUSE, PROVIDING A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
Mr. Path explained that the current zoning ordinance does not contain language that
differentiates between a vehicle storage lot and a wrecking yard. For clarity and consistency

with Chapter 35, he said staff recommends that the zoning ordinance be amended to include a
new definition for vehicle storage facility, as well as to assign the appropriate districts in which
this land use will be permitted. Mr. Path further explained this amendment would be adding
Towing and Vehicle Storage Lot as a new land use, and amending Section 8-105 to allow this
use in the Commercial Districts by SUP, and outright in Light Industrial and Heavy Industrial
Districts.
Mayor Clifford opened the public hearing and asked for anyone wishing to speak in
support or opposition of this zoning change, to please come forward. With no one speaking,
Mayor Clifford closed the public hearing.
A Motion to approve this item was made by Council Member Pilgrim and seconded by
Council Member Portugal. Motion carried, 6 ayes — 0 nays.
17. Discuss and act on the TxDOT CARES Act Airport Grant Agreement for the City of
Paris Municipal Airport, in the amount of $69,000.00; and authorize the City manager to
execute all necessary documents.
Mr. Path reported that the City of Paris Municipal Airport had been allocated $69,000.00
through the CARES Funding to assist it with airport -related expenditures related to operational,
inventory, personnel, capital, and outlay. He said the plan was to obtain the funds in the next
few months and use for capital improvements at the Airport.
A Motion to approve this item was made by Council Member Portugal and seconded by
Council Member Knox. Motion carried, 6 ayes — 0 nays.
18. Consider all matters incident and related to the issuance and sale of the City of Paris,
Texas Tax Note, Series 2020, including the adoption of ORDINANCE NO. 2020-058:
AUTHORIZING THE ISSUANCE OF SUCH NOTE AND ENACTING OTHER
PROVISIONS RELATED THERETO.
Finance Director Gene Anderson said Mark McLiney with SAMCO was going to give
the City Council a brief presentation on this item, as well as item 20.
A Motion to move item 20 up on the agenda was made by Mayor Clifford and seconded
by Council Member Portugal. Motion carried, 6 ayes — 0 nays.
Mark McLiney said four institutions bid on the tax notes and the bond refunding, with
local bank Liberty National Bank coming in with the winning bids. Mr. McLiney presented
details about the results, including interest rates, prior debt, refunding, savings, present value,
and the final costs. He also presented a timetable of events. (For reference, a copy of Mr.
McLiney's presentation is attached to these minutes)

A Motion to adopt an Ordinance authorizing the issuance and sale of the City of Paris,
Texas Tax Note, Series 2020 and enacting other provisions related thereto was made by Mayor
Clifford and seconded by Council Member Knox. Motion carried, 6 ayes — 0 nays.
20. Consider all matters incident and related to the issuance and sale of the City of Paris,
Texas General Obligation Refunding Bond, Series 2020, including the adoption of
ORDINANCE NO. 2020-059: AUTHORIZING THE ISSUANCE OF SUCH BOND
AND ENACTING OTHER PROVISIONS RELATED THERETO.
A Motion to adopt an Ordinance authorizing the issuance and sale of the City of Paris,
Texas General Obligation Refunding Bond, Series 2020 and enacting other provisions related
thereto. Motion carried, 6 ayes — 0 nays.
19. Discuss and act on ORDINANCE NO. 2020-060: AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PARIS, TEXAS, ADOPTING CHAPTER 33,
"VEHICLES FOR HIRE," PROVIDING A REPEALER CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A
PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
City Attorney Stephanie Harris said licenses had been approved for years to taxicab and
shuttle services via individual ordinance in conformance with Charter Section 124; however, the
Council had never adopted an ordinance that provided for a penalty for failure to obtain such a
license. Ms. Harris reviewed the changes, citing it would not affect the City's practice of
granting these licenses.
A Motion to approve this item was made by Council Member Pilgrim and seconded by
Council Member Savage. Motion carried, 6 ayes — 0 nays.
21. Consider and approve future events for City Council and/or City Staff pursuant to
Resolution No. 2004-081.
No future events were referenced.
22. Adjournment.
There being no further business, a Motion to adjourn was made by Council Member
Pilgrim and was seconded by Council Member Portugal. Motion carried, 6 ayes — 0 nays. The
