Item No. 11 <br />TO: Mayor & City Council <br />FROM: Grayson Path, City Manager <br />SUBJECT: 645 Johnson Woods Drive Channel Bank Stabilization (Gary Nash) <br />Contractor Contract Approval <br />DATE: December 14, 2020 <br />41 <br />TAO I K61 3@111 - <br />On July 27, 2020, the City Council approved an agreement with Gary and Rebecca Nash to <br />partner together in funding the installation of new gabion-style retaining wall in the drainage way <br />behind their property. The City had performed a sanitary sewer and erosion protection project in <br />this area, but at the time it was agreed that the Nash's sackrete wall would remain in place. The <br />sackrete wall subsequently failed. The Nash's and City came to an agreement to partner together <br />to fund the replacement of this wall. <br />Bids were received and opened on October 1, 2020. At the November 9, 2020 City Council <br />Meeting, the City Council awarded a bid to Bernal Commercial Construction, Inc. in an amount <br />of $56,985.00. <br />STATUS OF ISSUE: <br />Hayter Engineering has submitted the needed contract for City Council approval to begin the <br />work. The contract is a standard construction contract used by Hayter Engineering. Legal has <br />reviewed and approved. We need City Council approval to sign and execute the contract for <br />construction to begin. <br />BUDGET: <br />Per an agreement and subsequent amendment with Gary and Rebecca Nash, the City as agreed to <br />spend an amount not to exceed $33,000.00 on design and construction. The balance to be covered <br />by the Nash's. The total estimated cost for the project, including design and construction, is <br />$68,260.00. <br />
