1989-002-RES WHEREAS,CITY COUNCIL IN RES NO 88-016 AWARDED BID
RESOLUTION NO. 89-002
WHEREAS, the City Council of the City of Paris did hereto-
fore in Resolution No. 88-016 award the bid for furnishing labor,
material and equipment and performance of work required for
grounds maintenance on eight (8) City of Paris facilities, being
Bywaters Park, Plaza, City Hall, Paris Public Library, PJC
Triangle (24th S.E. & Clarksville St.), Chism Memorial Park,
Paris Police Dept., and lOth Street Park; and,
WHEREAS, Brad Gentry, dba Total Lawn Care Service was
awarded the bid for said City of Paris facilities and is no
longer able to perform the ground maintenance on said City of
Paris facilities and request that the City of Paris permit him to
assign his rights and obligations to maintain said City of Paris
facilities to the second low bidder, Rick Powell, Inc. which is
agreeable to assume the said rights and obligations upon the same
terms and conditions as was bid and awarded to Brad Gentry; and,
WHEREAS, the City Council did heretofore, in Resolution No.
88-090, authorize the assignment of the Cox Field Terminal area
described in Resolution No. 88-016 to Rick Powell, Inc., and.
WHEREAS, Rick Powell, Inc. has satisfactorily performed in
said Cox Field Terminal area; and,
WHEREAS, it would be in the best interest of the citizens of
Paris for said assignment be permitted and accepted; NOW
THEREFORE,
BE IT RESOLVED that the requested assignment of the rights
and obligations under contract dated March 14, 1988, between the
City of Paris, Owner and Brad Gentry, Contractor is approved;
and,
BE IT FURTHER RESOLVED by the City Council of the City of
Paris that the form of assignment attached hereto as Exhibit A be
and the same is hereby approved; and,
BE IT FURTHER RESOLVED that the mayor of the City of Paris,
Eric S. Clifford, be, and he is hereby authorized and directed to
execute on behalf of the City of Paris the acceptance of the
afore described assignment upon the terms and conditions in the
form of Exhibit A attached hereto.

KNOW ALL MEN BY THESE PRESENTS:
BRAD GENTRY, hereinafter called ASSIGNOR, dba Total Lawn
Care Service for $10.00 and other good and valuable consideration
the receipt and sufficiency of which is hereby acknowledged do
hereby bargain, sell and assign to RICK POWELL, INC., hereinafter
called ASSIGNEE, dba Powell Landscaping, all my right, deed and
interest in and to the right to maintain and be paid for said
maintenance on eight (8) City of Paris facilities, being Bywaters
Park, Plaza, City Hall, Paris Public Library, PJC Triangle (24th
S.E. & Clarksville St.), Chism Memorial Park, Paris Police Dept.,
and 10th Street Park, in the specifications attached to contract
dated the 14th day of March, 1988, by being Exhibit A attached to
Resolution 88-016.
IN WITNESS WHEREOF this assignment is executed on the day
and year first above written.
