1989-056-RES WHEREAS, CITY COUNCIL IN RES NO 89-055 DECLARED
RESOLUTION NO. 89-056
WHEREAS, the City Council of the City of Paris did this date
in Resolution No. 89-055, declare an emergency and authorize the
use of emergency powers and authorized the repair and restoration
by Insitufom reconstruction, approximately 2,600 feet of the
Central Interceptor 27" sanitary sewer transmission line from the
manhole near the south right-of-way line of Loop 286 N. W., 25
feet west of the Kiamichi Railroad Company, Inc. tracks east to a
point approximately 880 feet east of the east boundary line of
North Main Street; and,
WHEREAS, the City Engineer of the City of Paris, in
anticipation that the City Council of the City of Paris would
declare an emergency and authorize emergency powers on the 22nd
day of May, 1989, solicited proposals for the repair and
restoration by Insituform reconstruction the Central Interceptor
27" sanitary sewer transmission line from the manhole near the
south right-of-way line of Loop 286 N. W. 25 feet west of the
Kiamichi Railroad Company, Inc. tracks east to a point
approximately 880 feet east of the east boundary line of North
Main Street, being approximately 2,600 feet in length; and,
WHEREAS, a proposal was made by Insituform Texark, Inc., for
reconstruction using the Insituform method for a total price of
$359,766.00, and Earl Smith, City Engineer of the City of Paris,
recommends the acceptance of said proposal; and,
WHEREAS, the fom of contract attached hereto as
Exhibit A, should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the proposal of Insituform Texark, Inc., in the
amount of $359,766.00, for the reconstruction and repair of the
Central Interceptor 27" sanitary sewer transmission line from the
manhole near the south right-of-way line of Loop 286 N.W. 25 feet
west of the Kiamichi Railroad Company, Inc. tracks east to a
point approximately 880 feet east of the east boundary line of
North Main Street, being approximately 2,600 feet in length, be
and the same is hereby accepted, and,
BE IT FURTHER RESOLVED, That the form of contract
attached hereto as Exhibit A be approved; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, Eric S. Clifford, be, and he is hereby authorized and
directed to execute the contract with Insituform Texark, Inc., in
the fom of Exhibit A attached hereto.

CONTRACT AGREEMENT
THIS AGREEMENT, made and entered this 8th day of May, 1989, by
and between INSITUFORM TEXARK, INC. , hereinafter called
.contractor. and the city of paris, Paris, Texas, acting by and
through its Mayor, Eric Clifford, hereinafter called .city..
WITNESSETH THAT:
WHEREAS, the city of Paris acting under emergency powers granted
by the city council on the 8th day of May, 1989, solicited
proposals for the reconstruction or repair of the North
Interceptor approximately 2,607 feet from the manhole #18
station 59 + 12.18 manhole #10 station 33 + 08.91.
WHEREAS, Contractor did offer a proposal for Insituform
reconstruction for 2,607 linear feet of 27. diameter sewer for a
total price of $359,766.00, and Earl Smith, city Engineer of the
City of paris, recommends the acceptance of said proposal;
NOW, THEREFORE, IT IS AGREED:

That the Contractor shall comply with the requirements
of those certain specifications entitled
.specifications for Reconstruction Sewers by use of
Insituform..
That Contractor will provide all labor, materials and
equipment for the reconstruction of a portion of the
27 inch diameter sewer main.
That City has the right to terminate this contract
after pre-Insituform inspection and rendering of
estimate of point repairs, if any, by the payment of
$25,000.00.
That Contractor agrees to have in full force and
effect throughout the term of this contract a policy
of insurance in the following amounts:
A. General Liability - $1,000,000.00
B. Workers' compensation - Limits required by the
laws of the State of Texas.
That Contractor guarantees that the
workmanship furnished and performed
contract shall be guaranteed for one (1)
from the date of final acceptance of the
material
under
calendar
project.

EXHIBIT A
sixth: In the event City chooses to procee.d.with point
repairs, the cost of same shall be in addition to the
total contract price of $359,766.00.
Seventh: That in consideration of the faithful compliance with
the terms and conditions of this Agreement, City shall
pay to Contractor upon final acceptance of the project
$359,766.00, which payment is subject to the terms of
paragraph Three above. PaYment terms shall be net ten
davs.
IN WITNESS WHEREOF, said Contractor and said City have caused
this Agreement to be executed on the day and year first above
written.
