1989-061-1-RES WHEREAS,CITY COUNCIL IN RES NO 89-008 PASSED AND ADOPTED RESOLUTION NO. 89-061-1 WHEREAS, the City Council did heretofore in Resolution No. 89-008, passed and adopted on the 2nd day of January, 1989, accept Texas Department of Commerce Contract for Rental Rehabilitation Program; and, WHEREAS, it is understandings regarding Program under the State Department of Housing and necessary to set forth the the City's Rental Rehabilitation Program as approved by the U. S . Urban Development; and, WHEREAS, the Memorandum of Understanding Rental Rehabilitation Program reflects the understanding between the City of Paris and Paris Housing Authority, and the form of such memorandum attached hereto as Exhibit A should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the Memorandum of Understanding Rental Rehabilitation Program in the form of Exhibit A attached hereto is approved; and, BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, Eric S. Clifford, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the Memorandum of Understanding Rental Rehabilitation Program in the form attached hereto as Exhibit A. Clifford, Mayor ATTEST: Mattie Cunningham, ty Attorney MEMORANDUM OF UNDERSTANDING RENTAL REHABILITATION PROGRAM This Memorandum of Understanding ("Memorandum") is made and entered into and between the City of Paris, Texas, hereinafter referred to as "City", and the Paris Housing Authority, hereinafter referred to as "PHA". This Memorandum sets forth the understandings of the parties hereto concerning City's Rental Rehabi 1 itation Program ("Program") under the State Program as approved by the U.S. Department of Housing and Urban Development ("HUD") pursuant to Section 17 of the United States Housing Act of 1937 (42 USC 14370). The City has received rental rehabilitation funds from the Texas Department of Commerce, hereinafter referred to as "TDOC", in Federal Fiscal Year 1988 for its Program to finance the rehabilitation of rental properties for the benefit of lower-income families. The parties hereto have severally and collectively agreed and by the execution hereof are bound to the mutual obligations and to the performance and accomplishment of the tasks described herein. Section 1. CITY'S RENTAL REHABILITATION PROGRAM The City will carry out its Rental Rehabilitation Program in accordance with Section 17 of the U.S. Housing Act of 1937 (42 USC 14370) and other applicable Federal laws; the regulations in 24 CFR Part 511; and the Contract for Rental Rehabilitation Program ("RRP Contract") as made and entered into by and between the City and TDOC. SECTION 2. ADMINISTRATION OF VOUCHER PROGRAM The PHA administers the Section 8 Existing Housing Voucher Program funding provided by HUD in accordance with Section 8 of the U.S. Housing Act of 1937 (42 USC 1437f) and other applicable Federal laws; the regulations in 24 CFR Part 882; the Notice of Funding Availability for Section 8 Housing Voucher dated July 12, 1984; and other HUD regulations and requirements including the Annual Contributions Contract ("ACC") as made and entered into by and between HUD and the PHA, and the Administrative Plan and Equal Opportunity Housing Plan approved by HUD. SECTION 3. NOTICE OF NEED FOR ISSUANCE OF VOUCHERS The City agrees to carry out its Rental Rehabilitation Program in accordance with the schedule in its RRP Contract, Exhibit C, and will give the PHA notice of the actual need for issuance of Section 8 Vouchers needed for the relocation of low income families wishing to move from recently rehabilitated units under the TRRP. PHA will use vouchers/certificates from their existing program if any. E)(HLBlIA ~ SECTION 9. CITY/PHA INTERACTION The City of Paris, through the Director of Planning and Community Development or his designee, will initiate regular interac.tloo with the Executive Director of the Paris Public.Housing Authority or her designee regarding activities of the TRRP program; This will be done on a quarterly basis at minimum. Both the City and PHA will take advantage of training relevant to the TRRP. The PHA will have an opportunity to review and assist the City in the development of the Program Design, marketing strategy and the on-going ~dministrative procedures of the rental rehabilitation program. SECTION 10. INSPECTION As stated in the City's Program Design, pre and post construction inspections will be made through the City's inspection department. Pre construction inspections will be used to develop a list of code violations. Post construction inspections will be performed in keeping with permit requirements. All work will meet the requirements of the Paris, Texas Housing Code and the Housing Quality Standards. SECTION 11. TENANT INFORMATION In the event a recently completed unit is occupied by a tenant family assisted by the PHA, tenant information will be provided to the City by the PHA within 90 days of lease-up. SECTION 12. REFERRAL POLICY To the extent allowable under 24 CFR 882, the PHA will provide a list of available TRRP units to eligible families looking for housing.
