1989-062-RES WHEREAS, WILLOWTEX PIPELINE, A NEBRASKA CORPORATION, HAS CHOSEN TO TRANSVERSE
RESOLUTION NO. 89.062
WHEREAS, Willowtex Pipeline Company, a Nebraska Corporation,
has chosen to transverse the extraterritorial jurisdiction of the
City of Paris with a high pressure gas transmission line; and,
WHEREAS, the placing of such high pressure gas transmission
line within the City of Paris' incorporated limits, through its
extraterritorial jurisdiction, and across City of Paris' property
and public domain, requires the City of Paris to exercise
planning management of the rights of way, within which said high
pressure gas line is located; and,
WHEREAS, it is appropriate for such management and the cost
for furnishing the same be described in an agreement entitled
"Agreement In Lieu Of And For Franchise", attached hereto as
Exhibit A which should in all things be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
That the form of agreement entitled "Agreement In Lieu Of And For
Franchise", attached hereto as Exhibit A, is in all things
approved.
BE IT FURTHER RESOLVED, That the mayor of the City of Paris,
Eric S. Clifford, be, and he is hereby authorized and directed to
execute on behalf of the City of Paris the "Agreement In Lieu Of
And For Franchise" with Willowtex Pipeline Company and Tenaska
III Texas Partners in the form attached hereto as Exhibit A.
