1989-066-RES WHEREAS, TEX-OKO OUTDOOR ADVERTISING REQUESTED UTILITY EASEMENT FROM COP
RESOLUTION NO. 89-066
WHEREAS, Tex-Oko Outdoor Advertising has requested a Utility
Easement from the City of Paris on Lot 6, City Block 276, to
secure access to their outdoor advertising sign for lighting and
maintenance purposes; and,
WHEREAS, it is deemed to be in the best interest of the
citizens of the City of Paris to enter into a utility easement
with Tex-Oko Outdoor Advertising in order to allow proper
maintenance of the outdoor structure; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
That the Mayor of the City of Paris, Eric S. Clifford, be, and he
is hereby authorized and directed to execute on behalf of the
City of Paris the Utility Easement with Tex-Oko Outdoor
Advertising, upon the terms and conditions and in the form
attached hereto as Exhibit A.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LAMAR
That the CITY OF PARIS, PARIS, TEXAS, a municipal corpor-
ation, of Lamar County, Texas, acting by and through its Mayor,
Eric S. Clifford, duly authorized, does hereby Give, Grant,
Convey, Deliver and Confirm unto TEX-OKO OUTDOOR ADVERTISING of
Paris, Lamar County, Texas, whose mailing address is P. O. Box
647, Paris, Texas 75460, a utility easement for the purpose of
allowing Tex-Oko to secure lighting for its outdoor advertising
structure on property described as follows:
SITUATED within the corporate limits of the City
of Paris, County of Lamar and State of Texas, a part of
the Redding Russell Survey and being part of that
certain tract of land conveyed the City of Paris,
Texas, by deed recorded in Volume 238, Page 621, Deed
Records of Lamar County, Texas, being Lot 6, City Block
276, and being more particularly described as follows:
BEGINNING at the Northwest corner of said tract
conveyed the City of Paris, same being in the South
Boundary Line of Loop Highway 286;
THENCE South 570 09' East, with the South Boundary
Line of said Loop, a distance of 540 feet, the
Northeast corner of said tract;
THENCE South 20 26' IS" East, with the East
Boundary Line of said tract, a distance of 18.38 feet;
THENCE North 570 09' West a distance of 539.89
feet to a point in the West Boundary Line of said
tract;
THENCE North 30 19' 30" West, with said tract's
West Boundary Line, a distance of 18,44 feet to the
place of beginning and containing 0.186 acres of land,
more or less.
SAVE AND EXCEPT, the easement herein granted is conditioned
upon the CITY OF PARIS having the right to terminate all or part
of this easement in the event the CITY OF PARIS declares the need
to use the property included in this easement, or any portion
thereof, for municipal use. This easement runs concurrently with
the sign lease on this tract of land and if for any reason the
(90) days notice in writing of its intention to so utilize the
tract, or any portion thereof.
TO HAVE AND TO HOLD the above property unto TEX-OKOOUTDOOR
ADVERTISING for the purposes aforesaid, with the right and
privilege at any and all times to enter said premises, or any
part thereof, and maintaining any and all utilities facilities
placed therein; provided that Grantee will, after doing any work
in connection with the construction, reconstruction, relocating
or maintenance of said utilities facilities, restore the surface
to the condition to which said surface was found when such work
was undertaken, and that in the use of said rights and privileges
herein granted TEX-OKO OUTDOOR ADVERTISING will not create a
nuisance or do any act that will be detrimental to said premises.
Grantor does hereby bind itself, its successors and assigns,
to warrant and forever defend, all and singular, said premises
unto TEX-OKO OUTDOOR ADVERTISING against every person whomsoever
lawfully claiming or to claim the same or any part thereof.
