1988-135-RES WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 87-097 authorize an RESOLUTION NO. 88~135 WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 87-097 authorize an application to be made to the Office of the Governor of the State of Texas, Criminal Justice Division for a Texas Narcotics Control Grant; and, WHEREAS, thereafter Grant No. DB-87-B02-1941, entitled Regional Controlled Substance Apprehension program/l was awarded and accepted on December 11, 1987; and, WHEREAS, the Criminal Justice Division of the Governor I s Office has heretofore extended the grant period through April 30, 1989, and is offering to extend the grant period from May 1, 1989, through September 30, 1989, in an effort to put all programs statewide on the same schedule; and, WHEREAS, the extension of said grant through September 30, 1989, requires matching funds in the amount of $2,500.00, one third of which has been committed to by Lamar County and one third of which has been committed to by Red River County, leaving $833.33 to be provided by the City of Paris; and, WHEREAS, it is deemed to be in the best interest of the citizens of Paris that the City of Paris continue to participate in this Regional Controlled Substance Apprehension Program/l to suppress drug activity in and around the City of Paris; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS: 1. That an application be made to the Office of the Governor of the State of Texas, Criminal Justice Division for an extension of the Texas Narcotics Control Grant heretofore awarded as Grant No. DB-87-B02-l94l, entitled "Regional Controlled Substance Apprehension program/l to cover the period May 1, 1989, through September 30, 1989, and the attendant required funding in the amount of $70,062.00. 2. That Michael E. Malone, City Manager of the City of Paris, shall continue to be the authorized official of said project and is authorized and directed to execute on behalf of the City of Paris the application for grant extension of said grant and necessary attendant funding in the form attached hereto as Exhibit A. 3. That Benny Brothers continue as Temporary Project Director with authority to sign all instruments and documents concerned with said grant for the project director who has been appointed but shall remain nameless for the purpose of confidentiality. 4. Duties and responsibilities: Narcotics Officers (3): Serve in the field as undercover task force members to investigate, procure evidence and information regarding drug trafficking, production or processing, and to assist in the apprehension of those illegally producing, possessing, or transferring controlled substances. Report to Task Force Director. Task Force Director: Directs and coordinates activities of Task Force members to execute above mentioned responsibilities; interprets priorities as directed by Criminal Justice Division and Task Force Advisory Board. The City of Paris disburses funds monthly in lump sum to the Counties of Lamar and Red River for payroll disbursement through their finance offices. However, for the purpose of this application and the extension of the present grant year, the process will remain the same. CJD-14 continuation page 15a (Part IV - Program Narrative) Objectives and Need for this Assistance: Having realized our primary objective through the previous award of TNCP funds, "to mobilize a task force of full time personnel with the necessary funds to procure evidence and information . . . apprehension of those illegally producing, possessing,reor transferring controlled substances within. . . Red River, Lamar (Cos.) . . . City of Paris. . ." our present objective is to continue, accelerate and expand the existing operation. Prior to the Regional Controlled Substance Apprehension Program taking effect there was an uncoordinated effort attempting to deal with narcotics traffic in this area, given the transient nature of narcotics traffickers, as well as understaffing and underbudgeting among the area law enforcement agencies. Since the Paris Task Force was formed and a multi-jurisdictional effort has taken course, there has been a dramatic increase in the number of felony cases filed, marijuana eradication and seizures of clandestine labs. It is too early to produce comparative figures that will reflect the impact of Task Force activities, but we predict they will be substantial. We expect more than 100 felony indictments next month as the result of the Task Force. These were delayed partly because of lengthy involvement of prosecutors in several capital murder cases this year, but served to protect the identity of Task Force members for an extended period. We perceive the need to expand our territory, not only to protect our members' identity, but to obtain additional District Attorney contracts to insure continued operation through greater program income. We have no doubt that the instances of eradication efforts, lab seizures and felony indictments will escalate, since the initial phases of our present grant period were organizational, we reached our full complement of people mid-March, and only since about June have operated in full gear. We do not, for the purpose of this application, seek to address our expansion need. We feel that it will follow at a later date, with CJD approval. For the purpose of this application, we seek to continue. And only by.continuing shall we expand. The recognition of the Paris Task Force as an effective organization by other area agencies has brought demonstrated interest from Hopkins, Titus and Franklin Counties Sheriff's Offices, and the Cities of Sulphur Springs, Mt. Pleasant and Mt. Vernon Police Departments. Hopkins County and the City of Sulphur Springs have already expressed their interest to participate through Sep- tember 30, 1989 with personnel, vehicles and expenses at their own cost. Results or Benefits Expected: We expect to penetrate a wider area with intensified activity in the areas of felony indictments, marijuana eradication and seizures of clandestine labs, in addition to intensifying activity in our present area of operation. Our probable association with other area agencies (see attached map) will enable us to directlyiimpact a greater area. Through those associations and additional manpower and through the alliances we have established with other drug enforcement agencies (Department of Public Safety Narcotics Service, U.S. Drug Enforcement Administration), we will coordinate intensi- fied activities. Realizing the untimely nature of the Court System, we do not anticipate sizeable, immediate Program Income, but we do anticipate some program income in'the following year from seizures of the past twelve months. As we accelerate our activities under the present District Attorney contracts and expand to provide for additional DA con- tracts, we hope produce such Program Income as to be able to meet the 25 percent match required for future funding following the grant period of this application. Approach: Statement of Tasks Involved: We plan to pursue contracting with other agencies to widen our territory and with additional District Attorneys to increase our Program Income potential. We antici- pate some lag time following the more than 100 indictments we expect next month, as we shift personnel.from one location to another. As in the past, the Task Force Director will act as Project Director and be respon- sible for all record keeping and reporting to the Criminal Justice Division of the Governor's Office. The Finance Officer will continue to assume financial reporting and auditing responsibilities with the Criminal Justice Division and to oversee the disbursal of funds, including confidential funds, in accordance with the Guidelines for Control and Use of Confidential Funds. - --- The Project Director will continue as laison to the Task Force Advisory Board, Lamar and Red River County Sheriffs and Paris Police Chief, as well as other law enforce- ment agency heads, should the territory expand. While we will continue to impact direct narcotics trafficking, we intend to increase our efforts at marijuana eradi cati on and seizures of cl andesti ne' 1 abs. Projected Accomplishments: We plan to at least exceed our performance for this period last year. Our reports to CJD reflect more than 200 cases worked, with 40 felony indictments, but do not reflect the more"than 100 'felony indictments we expect next month. We plan to match or exceed our effort that resulted in the eradication of $3 million worth of marijuana, the seizure of $50,000 in land and real property, and the conviction on attempted murder charges of the perpetrator who shot the DPS helicopter, yet to be tried on five addi- tional felony counts. We plan to seize more clandestine labs, our past performance being the seizure of labs capable of producing one half million dollars worth of methamphetamine per "cook." We will see increased felony indictments as we widen our area of operation. We will enter into additional District Attorney contracts.
