BACKGROUND: The Pounders Law Firm with Abernathy Roeder Boyd & Hullett PC has
arranged for the private sale of twenty-four (24) tax delinquent properties that failed to get bids
during previous public tax sales.
STATUS OF ISSUE: On January 5, 2021, seventy-four (74) properties were put up for sale at the
public tax sale, and fifty (50) of those properties were sold; the remaining twent-four (24) tracts
were struck -off to the City of Paris, as trustee for itself, Paris Junior College, Lamar County and
Paris ISD. Subsequent to the auction, the remaining properties were advertised for sale inviting
private offers. The Pounders Law Firm with Abernathy Roeder Boyd & Hullett PC received offers
to purchase all twenty-four (24) properties (see attached resolution). Consent from the City of
Paris, Paris Junior College, Lamar County and Paris ISD is required to move forward with the
private re -sale of these 24 tracts.
BUDGET: The City will receive its prorated share of the proceeds of sale as required by the Texas
Property Tax Code.
RECOMMENDATION: Approve Resolution consenting to the Private Re -Sale of Twenty -Four
Tracts of Bid -Off Tax Foreclosed Properties as proposed.

A RESOLUTION APPROVING THE PRIVATE RE -SALE OF TWENTY-
FOUR TRACTS OF TAX FORECLOSED REAL PROPERTY AND
AUTHORIZING THE MAYOR TO EXECUTE DEEDS
WHEREAS, 24 tracts of real property (the "Trustee Properties") were bid off to the City of
Paris as Trustee for itself, Lamar County, Paris ISD and Paris Junior College at a public tax sale
conducted on January 5, 2021; and
WHEREAS, Texas Property Tax Code Section 34.05(i) provides that the Trustee Properties may
be sold by private sale in lieu of a public sale under Texas Property Tax Code Section 34.05(c) &
(d) with the approval of all taxing units entitled to receive proceeds from the sale, being the City
of Paris, Paris Junior College, Lamar County, and Paris ISD; and
WHEREAS, Private offers to purchase all twenty-four of the Trustee Properties were
subsequently received by the City of Paris (the "Private Sale");
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of Paris,
Texas, that:

Section 2. Subject to the Private Sale also being approved by Lamar County, Paris ISD and
Paris Junior College, the Mayor is hereby authorized to execute a tax deed conveying the Re -
Sale Properties to the Purchaser or designee.
Section 3. The proceeds of the Private Sale shall be distributed in accordance with the Texas
Property Tax Code and the orders of the District Courts of Lamar County, Texas.
