1988-017-RES WHEREAS, the City Council of the City of Paris, did in Resolution No. 88-009 on February 8, 1988, RESOLUTION NO. 88-017 WHEREAS, the City Council of the City of Paris, did in Resolution No. 88-009 on February 8, 1988, authorize the advertisement for bids for supplying all labor, equipment, and materials and performing all work required for the mowing of grass on all exterior sides of the taxiways, runways, and apron at Cox Field Municipal Airport, Paris, Texas, which bids were received until 10: 00 0' clock A.M., Wednesday, March 9, 1988; and, WHEREAS, the best bid for such construction was made by White's Mowing & Landscaping, 254 19th S.E., Paris, Texas, and it should be awarded the bid for such construction; and, WHEREAS, the form of contract for such construction project is attached hereto as Exhibit A, and such form should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Bid of White's Mowing and Landscaping in the amount of $395.00, is hereby accepted and let conditioned upon said contractor meeting all of the terms and specifica- tions included in the bid documents; and, BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, Billy Joe Burnett, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the contract with White's Mowing and Landscaping for the mowing of grass on all exterior sides of the taxiways, runways, and apron at Cox Field Municipal Airport, Paris, Texas, upon the terms and conditions and in the form shown in Exhibit A attached hereto. CONTRACT AGREEMENT THIS AGREEMENT, made and entered into this day of , 19 , by and between WHITE'S MOWING & LANDSCAPING, 254 19th S.E., Paris, Texas, hereinafter called the "Contractor" and the City of Paris, Paris, Texas, acting by and through its Mayor Billy Joe Burnett, hereinafter called "owner". WITNESSETH THAT: WHEREAS, pursuant to the invitation of the Owner, extended through an officially published "Invitation to Bid", the Contractor did in accordance therewith, on the 9th day of March, 1988, file with the Owner a proposal containing an offer which was invited by said notice; and/ WHEREAS, the Owner has heretofore determined that said offer was the lowest and best submitted: NOW, THEREFORE, IT IS AGREED: First: That the Contractor shall comply in every way with the requirements of those certain specifications entitled: Second: That in consideration of the faithful compliance with the terms and conditions of this Agreement the Owner shall pay to the Contractor at the times and in the manner provided in said specif- ication the total sum of Three Hundred Ninety-Five ($395.00), which sum is subJect, however, to increase or decrease in such proportion as the quantities named in said proposal are so changed, all as in said specifications and proposal provided. Third: That the contract documents which are hereby made a part of this Agreement by the actual attachment or by this reference thereto are as follows: 1. The Invitation to Bid - being the invitation to submit a proposal; 2. The Specification named above by title: Mowing of grass on all exterior sides of the taxiways, runways, and apron at Cox Field Municipal Airport, Paris, Texas. 3. The Detailed Plans listed and described in said specif- ications, together with those which may be issued as supplements thereof; and 4. The Proposal of the Contractor, which was submitted on March 9, 1988, the original or a conformed copy of which is hereto attached and marked "Exhibit A". Bids addressed to the Honorable Mayor and City Council, Office of the City Manager, City of Paris, P.O. Box 9037, Paris, Texas 75461-9037, will be received until 10:00 A.M., Wednesday, March 9, 1988, at which time all bids received will be publicly opened, tabulated, and referred to the Mayor and City Council for their consideration. Bidders are notified of City exemption from otherwise applicable sales and excise tax. The City of Paris reserves the right to reject any or all bids, to waive any informality in bidding, and to award ,as may be advantageous to the City. Notice to Bidders: Specifications and Bid Forms may be obtained at the Office of City Manager, City Hall, 135 S.L 1st Street, Paris, Texas. Areas to be mowed are shaded green on Attachment A. 2. Areas shall be mowed once every two weeks unless prohibited by extreme weather conditions. 3. Bidder is responsible for supplying all labor, equipment, and materials to perform the specified work. 4. Bidder must have current liability and workman's compensation insurance. 5. All correspondence concerning the grounds maintenance contract shall be through the Airport Manager. 6. The Airport Manager has the authority to suspend mowing operations when in his opinion the ground is too wet for mowing. 7. Bidders are responsible for removing dirt or mud that is deposited from tractor tires or mowers on the concrete areas. 8. Bidders will submit a bill to the airport manager upon completion of each mowing.
