RESOLUTION NO. 88-047
WHEREAS, the City of Paris acting under emergency
powers granted by the City Council on the 14th day of March,
1988, in Resolution No. 88-025, solicited proposals for the
reconstruction or repair of the North Interceptor from
approximately 365 feet from the manhole near the South
Right-of-Way line of Loop 286. N.E., Northeast to a manhole
North of the North Right-of-Way line of said Loop 286 N.E.;
and,
WHEREAS, a proposal was made by Insituform Texark,
Inc., for reconstruction using the Insituform method for a
total price of $69,450.00, and Earl Smith, City Engineer of
the City of Paris, recommends the acceptance of said
proposal; and,
WHEREAS, the form of contract attached hereto as
Exhibit A, should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the proposal of Insituform Texark, Inc., in the
amount of $69,450.00 for the reconstruction and repair of
the North Interceptor from approximately 365 feet from the
manhole near the South Right-of-Way line of Loop 286. N.E.,
Northeast to a manhole North of the North Right-of-Way line
of said Loop 286 N.E., be and the same is hereby accepted,
and,
BE IT FURTHER RESOLVED, That the form of contract
attached hereto as Exhibit A be approved; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, Billy Joe Burnett, be, and he is hereby authorized
and directed to execute the contract with Insituform Texark,
Inc., in the form of Exhibit A attached hereto.

CONTRACT AGREEMENT
THIS AGREEMENT, made and entered this 16th day of May,
1988, by and between INSITUFORM TEXARK, INC., hereinafter
called "Contractor" and the City of Paris, Paris, Texas,
acting by and through its Mayor, Billy Joe Burnett, herein-
after called "City".
WITNESSETH THAT:
WHEREAS, the City of Paris acting under emergency
powers granted by the City Council on the 14th day of March,
1988, solicited proposals for the reconstruction or repair
of the North Interceptor from approximately 365 feet from
the manhole near the South Right-of-Way line of Loop 286.
N.E., Northeast to a manhole North of the North Right-of-Way
line of said Loop 286 N.E.; and,
WHEREAS, Contractor did offer a proposal for Insituform
reconstruction for 353 linear feet diameter sewer for a
total price of $69,450.00, and Earl Smith, City Engineer of
the City of Paris, recommends the acceptance of said
proposal;
NOW, THEREFORE, IT IS AGREED:
First: That the Contractor shall comply
requirements of those certain specifications
"Specifications for Reconstruction Sewers by
Insituform."

Second: That Contractor will provide all labor,
materials and equipment for the reconstruction of a portion
of the 27 inch diameter sewer main crossing Loop 286 N.E.,
East of Stillhouse Road.
Third: That

City has the right to terminate this
Insituform inspection and rendering of
repairs, if any, by the payment of
Fourth: That Contractor agrees to have in full force
and effect throughout the term of this contract a policy of
insurance in the following amounts:
A. General Liability - $1,000,000.00
B. Workers' Compensation - Limits required by the
laws of the State of Texas.
EXHIBIT A
Fifth: That Contractor guarantees that the material
and workmanship furnished and performed under this contract
shall be guaranteed for one (1) calendar year from the date
of final acceptance of the project.

In the event City chooses to proceed with
the cost of same shall be in addition to the
price of $69,450.00.
Seventh: That in consideration of the faithful
compliance with the terms and conditions of this Agreement
City shall pay to the Contractor upon final acceptance of
the proj ect $69,450.00, which payment is subject to the
terms of paragraph Three above. Payment terms shall be net
10 days.
IN WITNESS WHEREOF, said Contractor and said City have
caused this Agreement to be executed on the d?y and year
first above written.
