WHEREAS, the City Council of the City of Paris has been
requested to provide the emergency medical services to that
area of Lamar County outside the city limits of the City of
Paris, by the Commissioners Court of Lamar County, Texas;
and,
WHEREAS, the form of contract to provide such service
is attached hereto as Exhibit A; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that emergency medical services be extended to that
area of Lamar County outside the city limits of the City of
Paris, upon the terms and conditions stated in the contract
attached hereto as Exhibit A, and that the Mayor of the City
of Paris, Eric S. Clifford, be, and he is hereby authorized
and directed to execute on behalf of the City of Paris the
Emergency Medical Services Contract with the Commissioners
Court of Lamar County, Texas, in the form of Exhibit A
attached hereto.

EMERGENCY MEDICAL SERVICES CONTRACT
STATE OF TEXAS ~
COUNTY OF LAMAR ~
This contract made and entered into this the 12th day of
September, 1988, by and between the CITY OF PARIS, Paris, Texas,
a body politic, acting by and through its Mayor, duly authorized,
hereinafter called City; and the COUNTY OF LAMAR, State of Texas,
acting by and through its County Judge, duly authorized,
hereinafter called County; hereby contract and agree as follows:
1. City covenants and agrees that it will furnish and
provide adequate emergency medical service vehicles and related
emergency medical services to all persons within the County of
Lamar, without regard to race, color, sex or national origin.
2. City covenants and agrees that it will comply with all
safety requirements of the law pertaining to the furnishing of
emergency medical service vehicles and emergency medical services
and that all vehicles used as emergency medical service vehicles
will be distinctly marked and colored as required by State law
and City ordinances. The emergency medical service shall be
referred to as "CITY OF PARIS EMERGENCY MEDICAL SERVICE" and the
vehicles used in providing said service shall bear the City of
Paris decal with the additional words, "serving PARIS and LAMAR
COUNTY."
3. City agrees that emergency medical service vehicle
attendants will be certified by the Texas State Department of
Heal th under the terms of the Emergency Medical Services Act,
Article 44470, Vernon's Texas Civil Statutes; that each emergency
medical service vehicle shall be staffed with at least two
emergency care attendants as required by Section 3.03, Subsection
5. City agrees that each vehicle used as an emergency
medical service vehicle shall be equipped with a two-way radio
which transmits and receives on frequencies designated by the
FCC. The radio communications to and from said emergency medical
vehicles and central dispatch shall be in coordination with and
by the knowledge of the Lamar County Sheriff's Office, the Paris
Police Department, and McCuistion and St. Joseph Hospitals, with
each hospital furnishing its own radio equipment.
6. City agrees that all vehicles used for emergency
service and the equipment contained therein will meet or exceed
requirements mandated by the Texas State Department of Health
attached hereto as Exhibit A, and that all emergency medical
vehicles and accessory equipment shall be subject to inspection
by designated representative of the County, and if at any time
same are not in compliance with the provisions hereof, or if any
emergency medical vehicle is in need of mechanical repairs in
order to insure its satisfactory operation, the said vehicle must
be removed from service.
7. City agrees that it will answer all emergency calls
within the limits of the City and County, and that no person
within the City and County shall be refused emergency service,
and further agrees that transfer emergency service when directed
by a medical doctor will not be refused, and agrees to deliver
patients to McCuistion and St. Joseph Hospital in the following
manner:
(a) To the hospital that victim, his personal physician or
next of kin so designate, or
(b) To the nearest hospital from the point of pick up of
the victim when his personal physician or next
of kin cannot respond to the emergency medical vehicle
8. City agrees that at all times during the effective
period of this contract to have procured and kept in force and
effect policy or policies of public liability insurance covering
each motor vehicle operated under this contract in the minimum
amounts of $250,000.00 for bodily injury or death to anyone
person and $500,000.00 for all persons injured in anyone
accident or occasion and $100,000.00 for property damages arising
out of anyone accident or occasion.
9. City agrees to furnish the County Judge, Lamar County,
an annual operating statement relating to revenues, expenses,
call statistics, and the status of delinquent and uncollectable
accounts, and that all non-medical records of the services
rendered under this contract, and training and certification
records of all employees, be available for inspection and review
by such County Judge or his designated representatives, and to
furnish a quarterly report in the form of Exhibit B attached
hereto.
10. City agrees to operate the emergency medical service
operation in accordance with the requirements of State law and
applicable requirements of City and County as may be in effect.
11. City agrees that it will have a minimum of two (2)
emergency medical vehicles which meet the emergency medical
vehicle and equipment requirements as set out in Paragraph 6
above, manned with a crew of two (2) men each, available to the
citizens of the City and County twenty-four (24) hours per day,
seven (7) days per week.
12. County agrees that non-emergency transfer service form
points within the City or County to points inside or outside the
County will be made at the prerogative of the City; that
emergency medical service from points outside the County to any
contract on a cash basis, with the County making monthly payments
of $15,526.00 monthly towards the estimated 12 month term cost of
$186,321. 00. The first of said monthly payments to be made on
the 1st day of October, 1988, with a like payment being made on
the first day of each month thereafter.
14. This agreement shall be effective and the term thereof
shall commence on the 1st day of October, 1988, and shall expire
on the 30th day of September, 1989.
15. It is further understood and agreed that neither the
County nor any of its agents, servants or employees shall be
considered to be in the business of providing emergency medical
service, and the relationship between the parties shall not be
considered to be that of a partnership or joint venture, and that
the status of the City shall be that of an independent contractor
providing services to the County and its inhabitants in exchange
for the payment of amounts herein set forth.
16. It is mutually understood and agreed between the
parties that the payments made by the County to City shall in no
way affect the right of City to collect the charges hereinafter
set out in Paragraph 17 from persons for emergency medical
service rendered, and it is expressly understood and agreed that
no one shall be entitled to free emergency medical service under
this contract, and diligent efforts shall be made to collect
accounts outstanding in keeping with good and ethical business
practices.
17. It is understood and agreed that charges for services
rendered under the scope of this contract within the limits of
the City and County shall be per patient, per call, as follows:

19. It is agreed that all calls for emergency medical
service that are received by County shall be referred to the CITY
OF PARIS AMBULANCE SERVICE operated by City.
20. In the event that the County desires continued
emergency medical service beyond the end of this contract, being
September 30, 1989, County shall give written notice to the City
on or before June 1, 1989, of its desire for service for an
additional term, and upon receipt of said notice on or before
June 20, 1989, City will deliver to County the rates and contract
price upon which it will deliver service, and thereafter on or
before July 1, 1989, County will execute the contract for service
for the additional term upon the same terms and conditions as
stated therein.

fiIS7.67. Basic Life Support Vehicle Requirements for a Pennit.
(a) Staffing requirements. The requirements for staffing a BI.S vehicle, when in service. shall be:
(I) from January I, 1984, through December 31.1984, with at least two individuals, one of whom shall be trained
to the emergency care allendantlevel and the other shal be the vehicle driver; and
(2) on and after January I. 1985, with at least two emergency care attendants.
(b) Provision of advanced care. Advance life support level of care may be provided on a BLS vehicle when the vehicle:
(I) is staffed by an SS-EMT or P-EMT acting under medical supervision; and
(2) has proper advanced life support equipment.
(c) Vehicle type specifications.
(I) Vehicles shall have:
(A) 40 inches of head room in the patient compartment;
(B) air conditioning and heating in proper working order in the patient compartment; and
(C) a multilevel stretcher capable of being secured to the vehicle.
(2) The patient compartment size should be 100 inches long by 62 inches wide without cabinets or 100 inches long
by 48 inches wide with cabinets.
(3) A vehicle holding permit prior to January I, 1984, issued under the authority of Texas Civil Statutes article
4590b, shall not be required to meet the vehicle type specifications of this subsection. Any vehicle applying for
an initiaol permit shall meet the vehicle type specifications of this subsection.
(d) Required equipment. The following BLS required equipment must be clean, in working order, and in sufficient
quantity to provide safe transport for patients in the individual service areas:
(I) one small, one medium, and one large size extrication cervical collar (soft foam rubber cervical collars are not
acceptable);
(2) one portable suction apparatus with wide tubing and suction tip (bulb syringe not acceptable);
(3) one bag mask unit with ,adult and child sized masks which can be used with an external oxygen supply;
(4) one infant bag mask unit which can be used with an external oxygen supply;
(5) oropbartngeal airways (nonmetallic) in adult, child, and infant sizes;
(6) one portable oxygen unit with adequate tubing and semi-open valveless, transparent masks in adult and child
sizes;
(7) two clean, padded bite sticks;
(8) two multi-trauma dressings approximately to-inch by; 3D-inch in size;
(9) a minimum of 5 dozen sterile gauze pads;
(10) one dozen soft roller, adhering bandages;
(11) one-half dozen sterile petroleum jelly impregnated gauze or suitable occlusive dressing;
(12) four rolls of adhesive tape;
(13) four sterile bum sheets;
(14) one traction splint with all attachments suitable for an adult and child; or one adult and one child traction splint;
(IS) padded board, cardboard. or aluminum splints as follows:
(A) two at least IS inches long by at least three inches wide;
(B) one at least 48 inches long by at least three inches wide; or
(C) may be, but not limited to, any of the following types of splints:
(i) inflatable splints;
(ii) foam-type rapid splints;
(iii) wire ladder splints;
(iv) commercial fracture pack;
(16) long and short spine board to include:
(A) one long six-foot board or commercial device; and
(B) one short spine board or commerical device; or
(C) commerical device which serves the purpose of both as provided in subsection d( 16)(A) and (B);

(26) two-way radio (citizen's bank radio and walkie-talkies are not acceptable); and
(27) fire extinguisher, at least a one-quart chemiealtype.
(e) Recommended equipment, The following equipment is recommended in addition to the required ambulance
equipment:
(I) nasopharyngeal airway;
(2) emesis basin;
(3) medium size dressing (five-inch by nine-inch or eight-inch by IO-inch);
(4) adhesive bandage strips;
(5) glucose or sugar for oral administration;
(6) cold packs;
(7) bvulb syringe (separated from aspirator included in obstetrics kit);
(8) plastic bags;
(9) paper bags; and
(10) sterile irrigation fluid,
