1988-072-RES WHEREAS, the City Council of the City of Paris did heretofore in Resolution 88-028, authorize the
RESOLUTION NO. 88-072
WHEREAS, the City Council of the City of Paris did
heretofore in Resolution 88-028, authorize the execution of
a contract for the construction of a Waste Water Lift
Station, Force Main and Gravity Sewer with Barney Bray III
and Paris, Texas Industrial Foundation, Inc.; and,
WHEREAS, said project is ahead of schedule necessitat-
ing the payment of the City's share to be made earlier than
previously anticipated; and,
WHEREAS, the form of Addendum No. 1 to the above
described contract is attached hereto as Exhibit A should be
in all things approved and the Mayor of the City of Paris,
Eric S. Clifford, should be authorized and directed to
execute said Addendum No. 1 to said contract; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the form of Addendum No. 1 to contract for
participation in the construction of a Waste Water Lift
Station, Force Main and Gravity Sewer, South of the South
right of way line of Loop 286 S. W. near its intersection
with Baker Branch, attached hereto as Exhibit A, be, hereby
in all things approved.
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, Eric S. Clifford, be, and he is hereby authorized and
directed to execute on behalf of the City of Paris, Addendum
No. 1 to Contract for Participation in the Construction of a
Waste Water Lift Station, Force Main and Gravity Sewer South
of the South R.O.W. Line of Loop 286 S.W. Near its Inter-
section with Baker Branch, shown in Exhibit A attached
hereto, with Barney Bray III and Paris, Texas Industrial
Foundation, Inc.

KNOW ALL MEN BY THESE PRESENTS:
THAT, the CITY OF PARIS, Paris, Texas, a municipal corpo-
ration, acting by and through its Mayor, Eric S. Clifford, duly
authorized, hereinafter called CITY; BARNEY BRAY III, a resident
of Paris, Lamar County, Texas, hereinafter called BRAY; and
PARIS, TEXAS INDUSTRIAL FOUNDATION, INC., a non-profit corpo-
ration acting by and through its President, J. D. MCLAUGHLIN,
duly authorized hereinafter called PIF, do hereby enter into an
addendum of the contract heretofore made by and between the
parties dated March 24, 1988, reference to which is made for all
purposes:
1. Paragraph 3 is amended to read as follows:
CITY agrees to procure and furnish necessary easements
and to provide the construction inspection of the construction
project.
CITY will pay $65,000.00 collected from CHISUM
INDEPENDENT SCHOOL DISTRICT as a connection fee on or before
construction begins and will additionally pay 25% of the total
construction cost, less any costs expended in condemnation of any
easements, which 25% is limited to a maximum of $50,000.00.
CITY's 25% constribution shall be payable in increments equal to
25% of each payment made to BRAY for construction of the 0.5 MGD
Lift Station, Force Main and Gravity Sewer Project, up to the
maximum of $50,000.00.
