1988-069-RES DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF PARIS, TEXAS, WATERWORKS AND RESOLUTION NO. 88-069 DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF PARIS, TEXAS, WATERWORKS AND SEWER SYSTEM PRIOR LIEN REVENUE BONDS, SERIES 1988 THE STATE OF TEXAS COUNTY OF LAMAR CITY OF PARIS WHEREAS, the City Council of the City of Paris, Paris, Texas, deems it necessary that the Bonds hereinafter described be authorized, issued, sold, and delivered as soon as possible; and, WHEREAS, it is hereby officially found and determined that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Resolution is passed, such emergency or urgent public necessity being that the notice of intention to issue revenue bonds should be p~blished as soon as possible and without delay for necessary and urgently needed public improvements; and that said meeting is open to the public and public notice of the time, place, and purpose of said meeting was given, all as required by Art. 6252-17, V .A. T .C.S. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS: , \ 1. That the following notice shall be published in a newspaper published in, and having general circulation in, the City of Paris, Texas, at least once a week for two consecutive weeks prior to August 22, 1988, with the date of the first publication to be not later than August 6, 1988, which is at least fourteen days prior to August 22, 1988: "NOTICE OF INTENTION TO ISSUE CITY OF PARIS, TEXAS WATERWORKS AND SEWER SYSTEM PRIOR LIEN REVENUE BONDS, SERIES 1988, IN THE PRINCIPAL AMOUNT OF $5,000,000 NOTICE IS HEREBY GIVEN, in accordance with Article 2368a, Vernon's Annotated Texas Civil Statutes, that the City Council of the City of Paris, Texas intends to pass at a Special Meeting to be held at 5:15 P.M., on August 22, 1988, at the City Council meeting room of the City Hall, in Paris, Texas, an ordinance authorizing the issuance, sale, and delivery of an issue of City of Paris, Texas Waterworks and Sewer System Prior Lien Revenue Bonds, Series 1988", in the principal amount of $5,000,000, to be payable from, and secured by a prior first lien on and pledge of the Pledged Revenues of the City's combined Waterworks and Sewer System, as defined in the Ordinance which authorized the City's outstanding City of Paris, Texas Waterworks and Sewer System Revenue Refunding Bonds, Series 1983, and all as will be defined and provided in the aforesaid ordinance. Said bonds will bear interest from their date at maximum rates not to exceed fifteen per centum per annum, will be scheduled to mature serially within a maximum of not to exceed thirty (30) years from their date, and will be subject to redemp- tion prior to maturity, and will have such other and further characteristics, as will be provided in the aforesaid ordinance. Said bonds will be authorized, issued, sold, and delivered pursuant to Articles lllla, 11l2, 11l3, 1114, and 1115, Vernon's Annotated Texas Civil Statutes and other applicable laws, for the purpose of providing money for improvements and extensions of the Waterworks and Sewer System of the City of Paris. The City Council of said City convened in REGULAR MEETING ON THE 11TH DAY OF JULY, 1988, at the City Hall, and the roll was called of the duly constituted officers and members of said City council, to-wit: Eric S. Clifford, Mayor Mattie cunningham, city Clerk Rondie L. Williams William E. (Bill) Davidson Marshall H. Kent, Jr. curtis Fendley E. w. (Bill) Booth Travis Wortham and all of said persons were present, except the fOllowing absentees: thus constituting a quorum. Whereupon, among other business, the following was transact- ed at said Meeting: a written RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF PARIS, TEXAS, WATERWORKS AND SEWER SYSTEM PRIOR LIEN REVENUE BONDS, SERIES 1988 was duly introduced for the consideration of said city Council and read in full. It was then duly moved and seconded that said Resolution be passed and adopted; and after due discussion, said motion carrying with it the passage and adoption of said Resolution, prevailed and carried by the following vote: AYES: All members of said city Council shown present above voted "Aye". NOES: None. 2. That a true, full and correct copy of the aforesaid Resolution passed and adopted at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Resolution has been duly record- ed in said city Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the passage and adoption of said Resolution; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sUfficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for passage and adoption at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Ann. civ. st. Article 6252-17. 3. That the Mayor of said City has approved and hereby approves the aforesaid Resolution; that the Mayor and the City Clerk of said City have duly signed said Resolution; and that the Mayor and the City Clerk of said City hereby declare that their signing of this Certificate shall consti- tute the signing of the attached and following copy of said Resolution for all purposes.
