SUBJECT: APPOINTMENTS TO THE BOARD OF ADJUSTMENT
DATE: June 28, 2021
BACKGROUND: The Board of Adjustment is created by State Law and codified under Section
16-100 of the City Zoning Ordinance. This Section states in part: "there is hereby created a
Board of Adjustment consisting of five (5) members, each to be appointed by resolution of the
City Council for a term of two years." The City Council may appoint two alternate members of
the Board of Adjustment who shall serve in the absence of one or more of the regular members
when requested to do so by the Mayor or City Manager.
STATUS OF ISSUE: Currently the terms of the two of the regular board members (Ruth Ann
Alsobrook & Larry Walker) and one alternate board member (Jathen Donaldson) are expiring on
June 30. There is also a vacant alternate position which needs to be filled. We have received
applications from the following: Ruth Ann Alsobrook, David Hamilton, and Larry Walker.
BUDGET: N/A
RECOMMENDATION: Approve a Resolution appointing/re-appointing two regular board
members and one alternate board member.
RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPOINTING MEMBERS TO FILL THREE VACANCIES DUE TO EXPIRING
TERMS ON THE BOARD OF ADJUSTMENT; TWO VACANCIES ARE
REGULAR MEMBERS AND ONE VACANCY IS AN ALTERNATE MEMBER IN
ACCORDANCE WITH SECTION 16 OF THE CITY ZONING ORDINANCE AND
THE CITY'S POLICIES AND PROCEDURES FOR STANDING BOARDS,
COMMISSIONS AND COMMITTEES; APPOINTING
AND TO SERVE AS REGULAR MEMBERS
FOR TWO YEAR TERMS ENDING ON JUNE 30, 2023 AND APPOINTING
TO SERVE AS AN ALTERNATE MEMBER FOR A
TWO YEAR TERM ENDING ON JUNE 30, 2 02 3; MAKING OTHER FINDINGS
AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 16-100 of the City of Paris, Texas Zoning Ordinance No. 1710
states in part that the Board of Adjustment shall consist of five (5) members, each to be
appointed by Resolution of the City Council for a term of two years and two (2) alternate
members for terms of two years; and
WHEREAS, currently the Board of Adjustment has three vacancies; and
WHEREAS, the vacancies are for a two-year term ending on June 30, 2021; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in
all things approved.
Section 2. That the following appointments are hereby made to the Board of
Adjustment: appoint and to serve two year terms
as regular members and to serve a two year term as an alternate
member all with terms ending June 30, 2023.
Section 3. That this resolution shall be effective from and after its date of passage.
