1987-052-RES WHEREAS, the City Council of the City of Paris did heretofore on March 16, 1987 in Resolution No. 87-

WHEREAS, the City Council of the City of Paris did
heretofore on March 16, 1987 in Resolution No. 87-031
authorize acquisition of utility easements for the relo-
cation of utilities in connection with Collegiate Drive
Improvement Project; and,
WHEREAS, an agreement has been reached with Larry
Walker, M.D., P.A., one of the property owners from which an
easement is required, to trade 0.46 acres adj acent to his
lot to him as consideration for the needed utility easement;
and,
WHEREAS, is deemed to be in the best interest of the
citizens of Paris to deed said 0.46 acres to Larry Walker,
M.D., P.A. and retain a temporary construction easement for
the construction of Collegiate Drive using the form attached
hereto as Exhibit A; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the Mayor of the City of Paris, Billy Joe
Burnett, be, and he is hereby authorized and directed to
execute on behalf of the City of Paris the General Warranty
Deed in the form of Exhibit "A" attached hereto to Larry
Walker, M.D.

County of Lamar, State of Texas, for and in consideration of
the sum of One and No/IOO Dollar ($1.00) cash and other good
and valuable consideration, in cash, to us in hand paid by
LARRY WALKER, M.D., P.A., the receipt and sufficiency of
which is hereby acknowledged; have Granted, Sold and Con-
veyed, and by these presents do Grant, Sell and Convey unto
the said LARRY WALKER, M.D., P.A., of the County of Lamar,
State of Texas, whose mailing address is 1090 Cardinal Lane,
Paris, Texas, 75460, all that certain tract or parcel of
land situated. in Lamar County, Texas, and described as
follows:
Situated within the corporate limits of
the City of Paris, County of Lamar, and State of
Texas, a part of the Hiram Williams Survey, and
being a part of Lot 12, Block 257 -D conveyed to
City of Paris as recorded in Volume 702, Page 157,
Deed Records, Lamar County, Texas, being more

corner of said City of Paris lot, said point being

Larry Walker, M.D., said point being in the SBL of

feet from proposed centerline survey station

of 157 feet from the North boundary line of
undeveloped Walnut Street;

SAVE AND EXCEPT the CITY OF PARIS does hereby retain a
temporary construction easement upon the above described
property for and during the construction period of the
Collegiate Drive Improvement Proj ect from Loop 186 N. E.
South to Lamar Ave. which shall terminate upon full accep-
tance of the City of Paris of said construction project.
TO HAVE AND TO HOLD the above described premises,
together with all and singular, the rights and appurtenances
thereto in anywise belonging unto the said LARRY WALKER,
M.D., P.A." his heirs and assigns forever; and it does
hereby bind itself, its successors and assigns to Warrant
and Forever Defend all and singular the said premises unto
the said LARRY WALKER, M.D., P.A." his heirs and assigns,
against every person whomsoever lawfully claiming, or to
claim the same, or any part thereof,
