RESOLUTION NO, 87-048
WHEREAS, the City Council of the City of Paris, did in
Resolution No. 87-023 on February 9, 1987 approve the
advertisement for bids for furnishing all material except
six inch diameter PVC pipe furnished by owner, labor, tools,
equipment, insurance, permits and performing all work
required for the Wastewater Sludge Disposal System Force
Main Project, which bids were received until 10:00 o'clock
A.M., Wednesday, March 4, 1987; and,
WHEREAS, the best bid for such construction was made by
R & K Energy, Inc., Rt 6 Box 210, Mt. Pleasant, Texas
75455, and it should be awarded the bid for such con-
struction; and,
WHEREAS, the form of contract for such construction
proj ect is attached hereto as Exhibit A, and such form
should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Bid of R & K Energy, Inc. in the amount of
$65,494.74, is hereby accepted and let conditioned upon said
contractor meeting all of the terms and specifications
included in the bid documents; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, Billy Joe Burnett, be, and he is hereby authorized
and directed to execute on behalf of the City of Paris the
contract for Wastewater Sludge Disposal System Force Main,
upon the terms and conditions and in the form shown in
Exhibit A attached hereto, with R & K Energy, Inc..

WITNESSETH THAT:

WHEREAS, pursuant to the invitation of the Owner, extended through an
officially publ ished "Invitation to Bid", the Contractor did in
accordance therewith, on the 4th day of March, 19 87,
file with the Owner a proposal containing an offer which was invitea-
by said notice; and
WHEREAS, the Owner has heretofore determined that said offer was the
lowest and best submitted:
NOW, THEREFORE, IT IS AGREED:
First: That the Contractor shall comply in every way with the
. requirements of those certain specjficattons entitled:
Wastewater Sludge Disposal System Force Main Pro'ect
(Official title of the specifications and a statement of
the limits to which they apply)
Second: That in consideration of the faithful compliance with the
terms and conditions of this Agreement the Owner shall pay to the
Contractor at the times and in the manner provided in said
specification the total sum of
Sixty-five Thousand, Four Hundred, Ninety-four and 74/100
(the basic contract price both in words an figures)
Dollars ($65,494.74)
which sum is subject, however, to increase or decrease in such
proportion as the quantities named in said proposal are so changed,all
as in said specifications and proposal provided.

Fourth: That the contract documents which are hereby made a part of

specifications, together with those with may be issued as
supplements thereof; and
4. The Proposal of the Contractor, which was submitted on
March 4 ,19M, the original or a conformed copy of
which is hereto attached and marked "Exhibit A".
IN WITNESS WHEREOF, said Contractor and said Owner have caused this
Agreement to be executed on the day and year first above written.
