1987-090-RES WHEREAS, the City Council of the City of Paris is desirous of improving the water service available to RESOLUTION NO. 87-090 WHEREAS, the City Council of the City of Paris is desirous of improving the water service available to Paris Junior College, Paris Independent School District's High School and the area adjacent to 24th Street S.E. from Clarksville Street south to Jefferson Road; and, WHEREAS, Paris Junior College and Paris Independent School District have agreed to the cost sharing agreement attached hereto as Exhibit A and made a part hereof; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That Billy Joe Burnett, Mayor of the City of Paris, be, and he is hereby authorized and directed to execute on behalf of the City of Paris a cost share contract with Paris Junior College and Paris Independent School Distric~ attached hereto as Exhibit A. E. SOUTH TO JEFFERSON ROAD (FM 1507) STATE OF TEXAS COUNTY OF LAMAR ~ ~ KNOW ALL MEN BY THESE PRESENTS: THAT, the CITY OF PARIS, Paris, Texas, a municipal corporation, acting by and through its Mayor, Billy Joe Burnett, duly authorized, hereinafter called CITY and PARIS JUNIOR COLLEGE, acting by and through the President of Paris Junior College Board of Regents, Doan Wall, hereinafter called PJC and PARIS INDEPENDENT SCHOOL DISTRICT, acting by and through its President of its Board of Trustees, William R. Lancaster, duly authorized, hereinafter called PISD, do hereby contract and agree as follows: 1. CITY agrees to construct a 12 inch water main beginning at a point 22~ feet North of the South right-of-way of E. Polk Street and 13~ feet East of the West right-of-way line of 24th S.E. Street in the intersection of E. Polk and 24th S.E. Streets; thence, in a Southerly direction along 24th S.E. to a point approximately 300 feet South of the center line of College Street, just North of Sycamore, and additionally construct a 10 inch diameter water main extension beneath Jefferson Road (FM 1507) from -1- E,OI,8ir ff the point of termination of the existing 10 inch water main on the East side of 24th S. E. Street to the existing 8 inch water main on the South side of Jefferson Road (FM 1507). PJC agrees to pay 527. of the cost of construction of the 12 inch diameter water main from Polk Street to Jackson Street, up to a maximum of $20,000.00. In addition to the cost of construction of the 12 inch diameter water main, PJC will pay the total construction cost of any fittings, valves, extensions, or other appurtenances placed in or extended from the 12 inch diameter water main for the purpose of serving the PJC water system. PJC will grant easements where necessary adjacent to 24th S.E. Street in the form of Exhibit A attached hereto. 2. PJC will make payments to CITY as follows: payments of 527. of draws relating to the 12 inch diameter water main up to a maximum of $20,000.00 and 1007. of the cost of draws relating to taps or extensions across 24th S.E. Street solely for the benefit of the PJC system, which amount is not included within the $20,000.00 maximum. 3. PISD agrees to pay 337. of the actual cost of the construction of the 12 inch water main extension from Polk Street to Sycamore Street and 1007. of the actual cost of the construction of the 10 inch diameter water main extension from the point of termination of the existing 10 inch water main on the East side of 24th S. E. Street near the North -2- right-of-way line of Jefferson Road (FM 1507) to the existing 8 inch water main on the South side of Jefferson Road (FM 1507) which necessarily includes a bore under Jefferson Road (FM 1507), up to a maximum of $40,000.00. PISD further agrees to grant an easement to CITY immediately adjacent to the South right-of-way line of Jefferson Road (FM 1507) from its West boundary line to its East boundary line, said easement to be 20 feet in width, in the form of Exhibit B attached hereto. 4. PISD will make payments to CITY as follows: Payments of 33% of draws relating to the 12 inch diameter water main and 100% of the draws relating to the extension under Jefferson Road (FM 1507) up to the total limit of $40,000.00. 5. PISD acknowledges its responsibility to provide an adequate fire protection system. Executed this ____ day of , 1987.
