1987-084-RES WHEREAS, the City Council of the City of Paris is aware of the development of East Park Center on Loop RESOLUTION NO. 87-084 WHEREAS, the City Council of the City of Paris is aware of the development of East Park Center on Loop 286 N.E. by George E. Shoemake and Terry Christian and the need for a utility and drainage easement in order that said property can be properly served with utilities and properly drained; and, WHEREAS, George E. Shoemake and Terry Christian have tendered the donation of such an easement described in Utility and Drainage Easement attached hereto as Exhibit A, and it is in the best interest of the City of Paris that such easement be accepted; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the donation of George E. Shoemake and Terry Christian of the easement described in Utility and Drainage Easement attached hereto as Exhibit A, is in all things accepted. Shoemake and Terry Christian, of Lamar County, Texas, for and in consideration of the sum of ONE DOLLAR ($1.00) cash, and other good and valuable consid- eration, to us in hand paid by the CITY OF PARIS, Paris, Texas, the receipt and sufficiency of which is hereby acknowledged, do hereby sell, give and grant unto the said CITY OF PARIS, a municipal corporation, of Lamar County, Texas, a utility and drainage easement described as follows: Situated within the Corporate limits of the City of Paris, Lamar County, Texas; being a part of the Joseph Leach Survey, Abstract No. 524; BEGINNING at a concrete monument for corner, said point being 80.00 feet left or Northeasterly from Loop 286 centerline station 223+00.00; THENCE North 65 degrees 24 minutes West, 103.3 feet along said Loop right-of-way to an iron pin set for corner; THENCE continuing along said Loop right-of- way along a curve to the left having a radius of 3882.72 feet and a central angle of 05 degrees 01 minutes 49 seconds, a distance of 340.9 feet to an iron pin set for corner; THENCE North 28 degrees 17 minutes East, 30.0 feet along the East boundary line of Phase I of East Park Center subdivision to a point; THENCE along a curve to the right having a radius of 3912.72 feet and a central angle of 05 degrees 01 minutes 49 seconds, a distance of 343.5 feet to a point; THENCE South 65 degrees 24 minutes East, 103.3 feet to a point; THENCE along a curve to the right having a radius of 3929.72 feet and a central angle of 01 degrees 54 minutes 30 seconds, a distance of 130.9 feet to a point in the East boundary line of Phase 3 of said East Park Center subdivision; THENCE South 03 degrees 00 minutes 00 seconds West, 36.1 feet along the East boundary line of said Phase 3 to an iron pin set for corner in the North boundary line of said Loop 286; THENCE along said Loop right-of-way along a curve to the left having a radius of 3899.72 feet and a central angle of 02 degrees 11 minutes 33 seconds, a distance of 149.2 feet to the place of beginning. TO HAVE AND TO HOLD the above property unto the CITY OF will, after doing any work in connection with the construction, reconstruction, relocating or maintenance of said utilities and drainage facilities, restore the surface to the condition to which said surface was found when such work was undertaken insofar as permitted under the plans and specifications approved for projects to be located within the herein described easement, and that in the use of said rights and privileges herein granted the CITY OF PARIS will not create a nuisance or do any act that will be detrimental to said premises.
