1987-077-RES WHEREAS, the City Council of the City of Paris did heretofore, in Resolution No. 86-001, award the
RESOLUTION NO. 87-077
WHEREAS, the City Council of the City of Paris did
heretofore, in Resolution No. 86-001, award the contract for
construction of Additions to Water Treatment Plant to
Heritage Constructor's, Inc.; and,
WHEREAS, the Special Project Engineer, John Buss,
recommends the amendment of said contract by Change Order
No. 10 attached hereto as Exhibit "A", which provides for a
net increase in contract price of $27,926.18 to a total of
$3,168,559.57 for 36" transfer pipe modification, deducting
Dixon pressure recorder, addition of raw water metering
loop, elevated storage telemetry, power circuit to Doppler
compressor, deducting loading dock driveway, raising manhold
Ill/Add step, raising manhole #2, payment revision, limit
switch at ground storage, lime subgrade processing allow-
ance, filter block restocking allowance, deducting unused
Class A concrete, deducting unused Class C concrete,
deducting unsued crushed stone backfill, reimbursing 1/2
Honeywell service charge, and modifying rapid mix basin,
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the contract for Additions to the Water Treat-
ment Plant is hereby amended by Change Order No. 10 attached
hereto as Exhibit "A" and the Mayor of the City of Paris,
Billy Joe Burnett, is hereby authorized and directed, on
behalf of the City of Paris, to execute said Change Order.

The following text shall be added to paragraph 13.2 under the section Tests and
Inspections, in Article 13-Warranty & Guaranty, on page 18 of the General Conditions of
the Contract:
"Contractor shall install isolation transformers on the incoming power circuit serving
the pump station facility. The proposed installation and equipment shall be approved
by the Engineer prior to installation. Upon installation, a six month test period
shall commence during which no component damage in the variable frequency drives, other
than fuses, shall be permitted to occur and no more than one unexplained automatic
disconnection of the variable frequency drives shall be permitted to occur. Lightning
and heavy winds are agreed to be potential explanations of automatic disconnection. If
the level of service provided by the variable frequency drives satisfies the conditions
of this test, then Owner will pay Contractor for cost of supplying and installing the
isolation transformers. The scope of the work undertaken by the Contractor as a part
of the installation effort and the price for that effort, as well as the price of all,
materials and equipment, shall be agreed upon prior to installation. Should the
equipment level of service provided by the variable frequency drives not satisfy the
test condition, then all rights available to the Owner during the warranty period under
the contract shall continue to be available to the Owner and Owner shall not be
obligated to pay for any equipment or installation effort associated with installation
of the isolation transformers. However, even if the level ~f service provided fails to
meet the performance test, should the contractor prove the quality of the power supply
of the incoming circuit is at fault and the quality is outside the range of normally
acceptable power supply standards, then Owner will pay for the isolation transformer
installation and equipment and furthermore Owner- will pay Contractor's expense of
investigation to supply said proof, provided that prior to starting said investigation,
Owner has agreed to the means, methods and cost of said investigation, and as to what
shall constitute proof.
