1986-001-RES WHEREAS, the City Council of the City of Paris, did at its special meeting on November 4, 1985 approve
RESOLUTION NO. 86-001
WHEREAS, the City Council of the City of Paris, did at
its special meeting on November 4, 1985 approve the
advertisement for bids for furnishing plant, labor,
materials and equipment and performing all work required for
the construction of Additions to Water Treatment Plant for
the City of Paris, Texas, which bids were received until
2:00 o'clock P.M., Wednesday, December 18, 1985; and,
WHEREAS, the best bid for such construction was made by
Heritage Constructors, Inc., POBox 5903, Texarkana, Texas
75505, and it should be awarded the bid for such
construction; and,
WHEREAS, it is to the best interest of the City of
Paris that items 10 and 13 of Heritage Constructors, Inc. 's
bid proposal be deleted resulting in a total bid in the
amount of $3,039,940.00; and,
WHEREAS, the form of contract for such construction
project is attached hereto as Exhibit A, and such form
should be approved: NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Bid of Heritage Constructors, Inc., less
items 10 and 13 resulting in a total bid amount of
$3,039,940.00, is hereby accepted and let conditioned upon
said contractor meeting all of the terms and specifications
included in the bid documents; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, George Fisher, Jr., be, and he is hereby authorized
and directed to execute on behalf of the City of Paris the
contract for construction of Additions to the Water Treat-
ment Plant, upon the terms and conditions and in the form
shown in Exhibit A attached hereto, with Heritage
Constructors, Inc.

WITNESSETH: That for and in consideration of the payments and agreements herein-
after mentioned, to be made and performed by the Party of the First Part (OWNER), and under
the conditions expressed in the bond bearing even date herewith, the said Party of the Second
Part (CONTRACTOR), hereby agrees with, the said Party of the First Part (OWNER) to
commence and complete the construction of certain improvements described as follows:
Additions to Water Treatment Plant, including blending tank, rapid mix basin,
floEculation/sedimentation basin, two filters, transfer pump station, water reclaimation
sys em, control/instrumentation. laboratory, office, valves, piping, roadways,
mechanical, structural, electr1cal, together with all necessary ~purtenances.
and all extra work in connection therewith, under the terms as stated in tne General Conditions
of the Agreement and at his (or their) own proper cost and expense to furnish all the materials,
supplies, machinery, equipment, tools, superintendence, labor, insurance, and other accessories
and services necessary to complete the said construction, in accordance with the conditions and
prices stated in the Proposal attached hereto, and in accordance with the Notice to Contractors,
General and Special Conditions of Agreement, Plans and other draw~nl1,s and printed or written
explanatory matter thereof, and the Specifications and addenda 7therefor, as prepared by_

herein entitled the ENGINEER, each of which ha. been identified by the CONTRACTOR and
the ENGINEER. together with the CONTRACTOR'S written Prapo.al, the General Conditions
of the Agreement, and the Performance and Payment Bond. hereto attached; all of which are made
a part hereof and collectively evidence and con.titute the entire contract.

The CONTRACTOR hereby agrees to commence work within ten (10) days after the date
written notice to do so shall have been given to him, and to substantially complete the same
calendar days
within 365 ~~ after the date of the written notice to commence work, subject
to such extensions of time as are provided by the General and Special Conditions.
THE OWNER agrees to pay the CONTRACTOR in current funds the price or prices shown in
the proposal, which forms a part of this contract, such payments to be subject to the General
and Special Conditions of the contract.
