RESOLUTION NO. 86-002
WHEREAS, the City Council of the City of Paris, did at
its special meeting on November 4, 1985 approve the adver-
tisement for bids for furnishing plant, labor, materials and
equipment and performing all work required for the con-
struction of 2 Million Gallon Steel Clearwell and Repainting
Existing Elevated Backwash Tank for the City of Paris,
Texas, which bids were received until 2: 00 0 I clock P.M.,
Wednesday, December 18, 1985; and,
WHEREAS, the best bid for such construction was made by
Advance Tank-Texas, Inc., Post Office Box 7273, Beaumont,
Texas 77706-7273, and it should be awarded the bid for such
construction; and,
WHEREAS, the form of contract for such construction
project is attached hereto as Exhibit A, and such form
should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Bid of Advance Tank-Texas, Inc. in the
amount of $367,814,00, is hereby accepted and let condi-
tioned upon said contractor meeting all of the terms and
specifications included in the bid documents; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, George Fisher, Jr" be, and he is hereby authorized
and directed to execute on behalf of the City of Paris the
contract for construction of 2 Million Gallon Steel
Clearwell and Repainting Existing Elevated Backwash Tank,
upon the terms and conditions and in the form shown in
Exhibit A attached hereto, with Advance Tank-Texas, Inc,
Passed and adopted this 13th day of January, 1986,

WITNESSETH: That for and in consideration of the payments and agreements herein-
after mentioned, to be made and performed by the Party of the First Part (OWNER), and under
the conditions expressed in the bond bearing even date herewith, the said Party of the Second
Part (CONTRACTOR), hereby agrees with the said Party of the First Part (OWNER) to
commence and complete the construction of certain improvements described as follows:
construct a 2 million gallon steel ground storage clearwell and repainting the
existing 100;000 gallon elevated backwash, tank, together with all appurtenances,
and all extra work in connection therewith, under the terms as stated in the General Conditions
of the Agreement and at his (or their) own proper cost and expense to furnish all the materials,
supplies, machinery, equipment, tools, superintendence, labor, insurance, and other accessories
and services necessary to complete the said construction, in accordance with the conditions and
prices stated in the Proposal attached hereto, and in accordance with the Notice to Contractors,
General and Special Conditions of Agreement, Plans and other drawings and printed or written
explanatory matter thereof, and the Specifications and addenda therefor, as prepared by_
Shimek, Jacobs & Finklea
herein entitled the ENGINEER, each of which has been identified by the CONTRACTOR and
the ENGINEER, together with the CONTRACTOR'S written Proposal, the General Conditions
of the Aj{reement, and the Performance and Pa)'DlCnt Bond. hereto attached; all of which are made
a part hereof and collectively evidence and con.titute the entire contract.

The CONTRACTOR hereby agrees to commence work within ten (10) days after the date
written notice to do so shall have been given to him, and to substantially complete the same
calendar days
within 320 Y",~after the date of the written notice to commence work, subject
to such extensions of time as are provided by the General and Special Conditions.
THE OWNER agrees to pay the CONTRACTOR in current funds the price or prices shown in
the proposal, which forms a part of this contract, such payments to be subject to the General
and Special Conditions of the contract.
IN WITNESS WHEREOF, the parties to these presents have executed this Agreement in
the year and day first above written.
