10/18/2021 MinutesMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMNIISSION MONDAY, OCTOBER 18, 2021 3:00 P.M. 1. Reeves Hayter called the Building and Standards Commission Meeting to order at 3:01 P.M. Roll was called. A. The following members were present: Reeves Hayter Richard Thompson entered at 3:04pm Kenneth Kohls Pat Conrad Kim Walker B. Staff present: Robert Talley Clyde Crews Nicki Brown Stephanie Harris Andrew Mack C. Others present: Reginald Hughes — City Council 2. Approval of minutes from previous meeting. (September 20, 2021). Motion made by Kim Walker and seconded by Ken Kohls to approve the minutes and to amend the misspelling of Ken Kohls name. Motion carried unanimously. 4-0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Chapter 4, Article 4.03 entitled "Substandard and Dangerous Buildings and Structures"; Chapter 7, Article 7.04 entitled "Weeds, Junk, and Other Objectionable, Unsightly, or Unsanitary Matter on Private Premises"; Chapter 8, Article 8.10 entitled "Outdoor Storage"; Code of Ordinances of the City of Paris, Paris, TX: B. 1008 SW 3rd; Locust Hill, Block 6, Lot 8 Owner: LA & Patsy Caldwell 924 SW 3rd Paris, TX 75460 Elliott Caldwell was present. Robert Talley stated that there are holes in the roof, trees limbs are on the roof, siding is coming apart from the door frame, unsecure with broken windows, roof is collapsing, and the shed in the back is in bad shape. Mr. Caldwell said he bought the house over a year ago with the intensions of demolishing the house but he doesn't have the means to tear the house down at this time and asked for more time. He also asked to repair the shed. Robert Talley's recommendation: Declare a nuisance, demo house within 30 days, repair the shed in 60 days, or city has right to do so. Discussion about time frame on tearing a house down and how to appeal a case to district court. Andrew Mack (Community Development Director) asked that the commission require Mr. Caldwell to pull a permit for demo on the property. The commission also asked that the property be secured within 14 days. Motion made by Richard Thompson, seconded by Kim Walker, to demo house in 90 days, secure property in 14 days and repair shed in 90 days or city has right to do so. Motion carried unanimously. 5-0 A. 343 Brown; Locust Hill, Block 1, Lot PT of 1 Owner: Nicholas J Dawson 725 Stroh Dr. Killdeer, ND 58640 No contract with owner. Robert Talley stated he brought this property to the commission about 6 months ago and it was condemned but then it sold. The roof is falling in, the tarp on the roof is falling off, and the structure has fire damage, missing and deteriorating wood and lots of junk and rubbish behind the structure. Robert Talley's recommendation: Declare a nuisance, demo within 30 days, or city has right to do so. Motion made by Richard Thompson, seconded by Reeves Hayter, to follow staff recommendation. Motion carried unanimously. 5-0 C. 513 E Sherman; City of Paris, Block 143, Lot 2 Owner: Ruby Scott 513 E Sherman Paris, TX 75460 No contract with owner. Robert Talley stated the City has been mowing this property for over a year, the property is unsecure with the doors open, the floor has dropped, hole in roof, house is sinking, west wall is falling out into the yard and it has missing and deteriorating wood. The shed has a hole in the roof and unsecure. Andrew Mack (Community Development Director) informed the commission that due to poor building practices in the past and unstable soil the City if trying to change codes for the better. I/ Robert Talley's recommendation: Declare both structures a nuisance, demo within 30 days, and city has right to do so. Motion made by Richard Thompson, seconded by Pat Conrad, to follow staff recommendation. Motion carried unanimously. 5-0 D. 835 NE 12th; Belmont Addition, Block 10, Lot Ctr 62' 10 & 11 Owner: HK Reo LLC 7200 N Mopac Expy Ste 120 Austin, TX 78731 Robert has talked to the owner. Robert Talley stated this was a sheriff's deed and it's unsecure with broken windows, the house is sinking, the house has holes in the roof, the structure is leaning, trees and vines are growing into the structure. Robert Talley's recommendation: Declare a nuisance, demo within 30 days, or city has right to do so. Motion made by Kim Walker, seconded by Ken Kohls, to follow staff recommendation. Motion carried unanimously. 5-0 E. 1255 SE 14th; Gibbons -Braden Addition, Block 8, Lot 18 Owner: Viola M McFadden 125414th SE Apt 146 Paris, TX 75460 No contract with owner. Robert Talley stated the owner to this property shows to live across the street and that's a vacant lot. The neighbor said the owner was deceased. The structure is unsecure with doors open, windows are broken, this is a single wide trailer house, the floor is soft, lots of full trash bags and junk and rubbish. Robert Talley's recommendation: Declare a nuisance, demo within 30 days, or city has right to do so. Motion made by Richard Thompson, seconded by Kim Walker, to accept Robert Talley's recommendation. Motion carried unanimously. 5-0 4. Adjournment Motion made by Kim Walker, seconded by Ken Kohls to adjourn the meeting at 3:36 pm.
