WHEREAS, the City Council of the City of Paris is aware
of the development of a tract of land preliminarily platted
as "Echols Commercial Addition" and the need for a utility
easement in order that said property can be properly served
with utilities; and,
WHEREAS, Leslie R. Echols and Wife, Reba Bryant Echols
have tendered the donation of such an easement described in
Utility Easement attached hereto as Exhibit A, and it is in
the best interest of the City of Paris that such easement be
accepted; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the donation of Leslie R. Echols and Wife, Reba
Bryant Echols of the utility easement described in Utility
Easement attached hereto as Exhibit A, is in all things
accepted.

That We, LESLIE R. ECHOLS AND WIFE, REBA BRYANT ECHOLS,
of Lamar County, Texas, for and in consideration of the sum
of ONE DOLLAR ($1.00) cash, and other good and valuable
consideration, to us in hand paid by the CITY OF PARIS,
Paris, Texas, the receipt and sufficiency of which is hereby
acknowledged, do hereby sell, give and grant unto the said
CITY OF PARIS, a municipal corporation, of Lamar County,
Texas, a utility easement described as follows:
Situated within the corporate limits of the
City of Paris, Lamar County, Texas; being a part
of the Joseph Leach Survey, Abstract No. 524; and
being a part of a called 152.21 acre tract of land
described in a Deed from Fred Kirby and wife to
Leslie R. Echols and wife, dated December 14,
1948, recorded in Volume 309, Page 603, Lamar
County Deed Records.
BEGINNING at an iron pin set for corner in
the East boundary line of F.M. Highway No. 1507,
said point being Northerly a distance of 372.1
feet from a concrete monument found at the inter-
section of the East boundary line of said F .M.
Highway 1507 with the North boundary line of
Southeast Loop 286;
THENCE South 89 degrees 59 minutes East,
600.2 feet;
THENCE North 67 degrees 47 minutes East,
223.0 feet;
THENCE North 58 degrees 10 minutes East,
108.0 feet;
THENCE North 58 degrees 11 minutes East,
215.4 feet to a point in the West boundary line of
an existing 15 foot wide sewer easement;
THENCE North 17 degrees 21 minutes West, 15.5
feet along the West boundary line of said easement
to a point;
THENCE South 58 degrees 11 minutes West,
193.0 feet;
THENCE South 58 degrees 10 minutes West,
133.0 feet;
THENCE South 67 degrees 47 minutes West,
218.9 feet;

privilege at any and all times to enter said premises, or
any part thereof, and maintaining any and all utilities
facilities placed therein; provided that Grantee will, after
doing any work in connection with the construction, recon-
struction, relocating or maintenance of said utilities
facili ties, restore the surface to the condition to which
said surface was found when such work was undertaken in so
far as permitted under the plans and specifications approved
for projects to be located within the herein described
easement, and that in the use of said rights and privileges
herein granted the CITY OF PARIS will not create a nuisance
or do any act that will be detrimental to said premises,
Grantors do hereby bind themselves, their heirs,
executors and administrators, to warrant and forever defend,
all and singular, said premises unto the CITY OF PARIS
against every person whomsoever lawfully claiming or to
claim the same or any part thereof.
