1986-044-RES WHEREAS, the City Council of the City of Paris did heretofore approve the Plat - Showing Easements, RESOLUTION NO. 86..,044 WHEREAS, the City Council of the City of Paris did heretofore approve the Plat - Showing Easements, Part of Lot 1, Lot 2A and Lot 3, City Block 313, on the 7th day of November, 1985, which plat is recorded in Envelope 280-C, Plat Records, Lamar County, Texas, which shows thereon a SO foot easement adjacent to the East boundary lines of Lots 2B and 2C which easement has never been used by the public and was never opened to the public and that no public road or street construction has occurred upon such SO foot easement; and, WHEREAS, it is not the custom or practice of the City of Paris to accept easement dedication for the purpose of construction of public streets, the usual and customary method being the dedication of or granting of by Right- of-way Deeds; and, WHEREAS, it is found that the SO foot easement shown adjacent to the East side of Lots 2B and 2C of the Plat recorded in Envelope 280C is hereby found to serve no public purpose and therefore, it would be right and proper to close, abandon and vacate the same and for the Mayor of the City of Paris to execute a Quit Claim of said easement to David W. Glass and Centerpoint, Ltd.; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the SO foot easement depicted on the Plat - Showing Easements, Part of Lot 1, Lot 2A, and Lot 3, City Block 313 heretofore approved on the 7th day of November, 1986, is closed, abandoned and vacated; and, BE IT FURTHER RESOLVED, That the Mayor, Billy Joe Burnett, be and he is hereby authorized and directed to execute on behalf of the City of Paris the quit claim deed to David W. Glass and Centerpoint, Ltd. in the form of Exhibit A attached hereto; and, BE IT FURTHER RESOLVED, That the 20 foot easement depicted on the Final Plat of Lot 2C and Part of Lot 3, City Block 313 (3.763 Acres) to be recorded in the Plat Records of Lamar County, Texas, is accepted, which plat was presented and executed by the owners of all of the property effected thereby being David W. Glass and Centerpoint, Ltd., partially modifies the plat heretofore recorded in Envelope 280-C, Plat Records, Lamar County, Texas. Passed and adopted this 12th day of May, 1986, ATTEST: QUIT CLAIM DEED STATE OF TEXAS ~ KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR ~ THAT the City of Paris, a municipal corporation, acting by and through its Mayor, Billy Joe Burnett, duly authorized, of Paris, Lamar County, Texas; for an in consid- eration of TEN AND NO/100 DOLLARS cash and other good and valuable consideration, to me in hand paid by David W. Glass, and Centerpoint, Ltd., of the County of Lamar and State of Texas, the receipt whereof is hereby acknowledged, has quit claimed, and by these presents do quitclaim, unto the said David W. Glass and Centerpoint, Ltd., all our right, title, interest, claim and demand in and to a certain lot or parcel of land situated within the corporate limits of the City of Paris, Lamar County, Texas, described as follows: A part of the Joseph Leach Survey #524, and being part of a 9.73 acre tract of land as described in deed to Jesse Wintermute and recorded in Volume 685, Page 220, of the Deed Records of Lamar County, Texas, and being part of a SO foot easement as shown on a plat filed for record in Envelope 279-A of the Plat Records of said County and State, and being more particularly described as follows: BEGINNING at a point for corner, said point being N 0017'E a distance of 20 feet from an iron pin found in the North Boundary Line of Block A of the Morningside Addition to the City of Paris, same being the Southwest corner of Lot 2-C, City Block 313, as shown on a final plat of part of said block as filed for record in Envelope 280-C, of the Plat Records of said County and State; THENCE S 89036' E a distance of 30 feet, a point; THENCE N 0017' E a distance of 883.6 feet, a point; THENCE West a distance of 30 feet, an iron pin found for corner in the West Boundary Line of said 9.73 acre tract of lRnrl Q~mQ hQ<~_ ~~_ and appurtenances thereto belonging or in any wise pertaining; to have and to hold the above released rights, titles, interests, claims, and demand, to the said David W. Glass and Centerpoint, Ltd" their heirs and assigns, forever, so that neither City of Paris, its successors or assigns shall have any right or title to or interest in such property, premises or appurtenances, or any part thereof, at any time hereafter.
