WHEREAS, the City Council of the City of Paris did
heretofore receive a request for additional water pressure
and service requiring a water main extension to the area
bounded on the south by Loop 286, on the east by Stillhouse
Road, on the north by the City Limit line and on the west by
North Main Street; and,
WHEREAS, it is deemed necessary for protection of the
health and welfare of the above described area for the City
of Paris to extend the above described line and act in the
capacity of sponsor under the terms of Section IX of Sub-
division Ordinance No. 1315 of the City of Paris with any
refunds due under the pro rata charges being paid to the
City of Paris water and sewer fund; and,
WHEREAS, upon receipt of the above described request,
preliminary plans, specifications and estimate of the total
cost of the project were prepared and delivered to the City
Manager and considered at the regular Council Meeting on the
13th day of January, 1986, and a public hearing concerning
the same was set for February 13, 1986, which public hearing
was rescheduled at the regular Council Meeting on the 10th
day of February, 1986, for the 24th day of March, 1986, at
which time such public hearing was held; and,
WHEREAS, after hearing the matters presented at the
public hearing the City Council is of the opinion that it is
in the best interest of the citizens of Paris and particu-
larly the citizens in the vicinity of the proposed project
that the City of Paris act as sponsor for said project,
which is necessary for the protection of health and welfare
in this area; that the front foot method would be inequit-
able due to the fact that the beneficiaries derive unequal
benefits, require different volumes of water and different
water pressures; and that the method described on Exhibit A
attached hereto, as recommended by the staff, would be
equitable; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the pro rata water main extension, beginning at
Fitzhugh Avenue's (Stillhouse Road) intersection with
Clement Road running Northerly with said Fitzhugh Avenue
(Stillhouse Road) to Loop 286 N.E.; thence in a Westerly
direction with said Loop 286 N.E. to an existing casing;
thence under Loop 286 N, E. through the existing casing to
an existing 10" main to serve the area bounded on the south
by Loop 286, on the east by Stillhouse Road, on the north by
the City Limit line and on the west by North Main Street,
be, and the same is hereby approved and shall be known as
"Fitzhugh, Stillhouse Road, Loop 286 N,E., Pro Rata Water
Main Extension"; and,
BE IT FURTHER RESOLVED, That the City of Paris act as
sponsor of said pro rata water main extension; and,

IT FURTHER RESOLVED, That the front foot rule would
equitable and the alternate method described in

Exhibit A attached hereto, which shall be used for the
purpose of the charging of the pro rata charges to the

of Paris,

1. The Pro Rata Share of Cost for the L,P, McCuistion Regional
Medical Center shall be 28% of the total cost of construction,
engineering, inspection and project administration to a maximum
of $20,000,00.
2, The Pro Rata Share of Cost for properties located South of Loop
286 shall be 60% of the total cost of construction, engineering,
inspection and project administration, Refunds due for this
section shall be paid based upon the potential commercial or
residential use of the property and upon the lot frontage
adjacent the Project,
Owners benefiting from service available to property with
conmercial potential shall refund the equivalent of 60% of the
cost of constructing a ten inch (10") water main from point A to
point C, as shown on the property owners map attached hereto,
less that cost to be refunded by owners of property located
adjacent to the Project and having residential potential,
