1986-023-RES WHEREAS, the City Council of the City of Paris, did at its regular meeting on December 9, 1985, approve RESOLUTION NO. 86-023 WHEREAS, the City Council of the City of Paris, did at its regular meeting on December 9, 1985, approve the adver- tisement for bids for furnishing plant, labor, materials and equipment and performing all work required for the 1985 Wastewater Treatment Plant Improvements, Proj ect No. 15-86-21, including a reinforced concrete flow tapping vault; a flow splitter and grit removal chamber equipped with velocity paddles and grit pump; a screening building to house six static screens, two screw conveyors, and motor control center equipment; a biotower pumping station equipped with four vertical mixed flow pumps; a biotower rotary distributor, synthetic media, and modified tank structures; addition of new aeration discs to the existing aeration basins and all associated electrical, yard and appurtenant work, which bids were received until 10:00 o'clock A.M" Wednesday, January 15, 1986; and, WHEREAS, the best bid for Four Thirteen, Inc., RR 14, 75501, and it should be construction; and, such construction was made by Box 305 Z, Texarkana, Texas awarded the bid for such WHEREAS, the form of contract for such construction project is attached hereto as Exhibit A, and such form should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Bid of Four Thirteen, Inc., in the amount of $1,459,000,00, is hereby accepted and let conditioned upon said contractor meeting all of the terms and specifications included in the bid documents; and, BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, George Fisher, Jr., be, and he is hereby authorized and directed to execute on behalf of the City of Paris the contract for the 1985 Wastewater Treatment Plant Improve- ments, Proj ect No, 15-86-21, upon the terms and conditions and in the form shown in Exhibit A attached hereto, with Four Thirteen, Inc. Citv C er AGREEMENT FORM THIS AGREEMENT, made the lOth day of March , 19 8~ by and between the City of Paris, Paris, Texas, acting through its Mayor and Council and their duly authorized agents, referred to in these Contract Documents as "Owner", and Four-Thirteen Incorporated referred to in these Contract Documents as "Contractor": IIITNESSETH: THAT IIHEREAS: in accordance with law, Owner has caused Contract Documents to be prepared and an Invitation To Bid to be published, for and in connection with Contract 15-86-21, 1985 lIastewater Treatment Plant Improvements; and IIHEREAS, Contractor, in response to the Invitation To Bid, has submitted to Owner, in the manner and at the time specified, a sealed Bid in accordance with Instructions To Bidders; and IIHEREAS, Owner, in the manner prescribed by law, has publicly opened, examined, and canvassed the Bids submitted, and has determined Contractor to be the lowest and best Bidder for the lIork and duly awarded to Contractor a Contract therefor, for the sum or sums named in Contractor's Bid. NOli, THEREFORE, in consideration of the compensation to be paid to Contractor and of the mutual agreements herein contained, the parties to these presents have agreed and hereby agree, Owner for itself and its successors, and Contractor for itself, himself, or themselves, and its, his, or their successors and assigns, and its, his, or their executors and administrators, as follows: ARTICLE I. Contractor shall perform all lIork, including the assumption of all obligations, duties, and responsibilities necessary to the successful com- pletion of the Contract and the furnishing of all materials and equipment required to be incorporated in and form a permanent part of the lIork; tools, equipment, supplies, transportation, facilities, labor, superintendence, and services required to perform the lIork; and Bonds, insurance, and submittals; all as indicated or specified in the Contract Documents to be performed or furnished by Contractor for the lIork included in and covered by Owner's official award of this Contract to Contractor, such award being based on the acceptance by Owner of Contractor's Bid, or part thereof, as follows: Base Bid ARTICLE II. That Owner shall pay to Contractor for performance of the lIork embraced in this Contract, and Contractor shall accept as full compensation therefor, the sum (subject to adjustment as provided in the Contract Documents) of One Million Four Hundred and Fifty Nine Dollars ($ 1,459,000.00) (PARIS, TEXAS ) (\I\ITP IMPROVEMENTS) (12445 ) A-I EXHIBIT "A" for all Work covered by and included in the contract award and designated in the foregoing Article I; payment thereof to be made in current funds in the manner provided in the Contract Documents. ARTICLE III. That Contractor shall substantially complete the Work by March 31, 1987, and shall complete all Work by May 31, 1987. ARTICLE IV. That the Contract Documents which comprise the Contract between Owner ana-Contractor, attached hereto and made a part hereof, consist of the documents listed in Table of Contents, and the documents identified below. Addenda numbers 1 and 2. Information submitted by Contractor prior to the time Owner issues Notice of Award: Contractor's letter dated January 16, 1986 regarding equipment to be installed. Engineer's letter dated January 31, 1986 regarding equipment to be installed. Notice of Award, Notice to Proceed.
