1986-020-RES WHEREAS, the City Council of the City of Paris, did heretofore approve the Plat - Showing Easements, RESOLUTION NO. 86-020 WHEREAS, the City Council of the City of Paris, did heretofore approve the Plat - Showing Easements, Part of Lot 1, Lot 2A and Lot 3, City Block 313, on the 7th day of November, 1985, which plat included an easement that was the part of Lot 3, Block 313, which easement was 50 feet in width; and, WHEREAS, upon review of the same it has been determined that a 20 foot easement is sufficient for the designated purpose and therefore it would be appropriate to quit claim the remaining 30 feet of said easement back to the owner in order that the same could be fully utilized; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the Mayor of the City of Paris, George Fisher, Jr" be, and he is hereby authorized to execute on behalf of the City of Paris the quit claim to David Glass, owner of Lot 3, Block 313, in the form of Exhibit A attached hereto, Passed and adopted this 24th day of February, 1986, ~ 9~ eo ~h~r, Jr" ' ayor ATTEST: ~~">~~ Mattie Cunn~ng am, City C er APPROVED QUIT CLAIM DEED STATE OF TEXAS ~ KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR ~ THAT the City of Paris, a municipal corporation, acting by and through its Mayor, George Fisher, Jr" duly authorized, of Paris, Lamar County, Texas, for an in consid- eration of TEN AND NO/IOO DOLLARS cash and other good and valuable consideration, to me in hand paid by David W. Glass, of the County of Lamar and State of Texas, the receipt whereof is hereby acknowledged, has quit claimed, and by these presents do quitclaim, unto the said David W, Glass, all our right, title, interest, claim and demand in and to a certain lot or parcel of land situated within the corporate limits of the City of Paris, Lamar County, Texas, described as follows: A part of the Joseph Leach Survey #524, and being part of a 9,73 acre tract of land as described in deed to Jesse Wintermute and recorded in Volume 685, Page 220, of the Deed Records of Lamar County, Texas, and being part of a 50 foot easement as shown on a plat filed for record in Envelope 279-A of the Plat Records of said County and State, and being more particularly described as follows: BEGINNING at a point for corner, said point being N 0017'E a distance of 20 feet from an iron pin found in the North Boundary Line of Block A of the Morningside Addition to the City of Paris, same being the Southwest corner of Lot 2-C, City Block 313, as shown on a final plat of part of said block as filed for record in Envelope 280-C, of the Plat Records of said County and State; THENCE S 89036' E a dis tance of 30 feet, a point; THENCE N 0017' E a distance of 883,6 feet, a point; THENCE West a distance of 30 feet, an iron pin found for corner in the West Boundary Line of said 9,73 acre tract of land, same being the Northeast corner of Lot 2-B, City Block No. 313; THENCE S 0017' W, with the West Boundary Line pertaining; to have and to hold the above released rights, titles, interests, claims, and demand, to the said David W. Glass, his heirs and assigns, forever, so that neither City of Paris, its successors or assigns shall have any right or title to or interest in such property, premises or appurtenances, or any part thereof, at any time hereafter.
