SUBJECT: Act on approval for a resolution on the petition adopting findings of fact
consistent with denial by Judy Daugherty for a change in zoning from a One -
Family Dwelling District No. 2 (SF -2) to a Two -Family Dwelling District (2F) in
the Willowcrest #2 Addition, Block A, Lot 7, located at 1315 NE 26th Street-
LCAD 39756.

BACKGROUND
At its meeting held on December 13, 2021, the City Council unanimously approved denial of the
above rezoning request by Judy Daugherty. The council also adopted a second motion to approve
directing staff to prepare a resolution with findings of fact consistent with denial to be brought back
for final action by the Council. That resolution is attached with this memo.
RECOMMENDATION
Approve resolution denying the petition of Judy Daughtrey with findings of fact consistent with
denial for the above request.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS
DENYING THE PETITION OF JUDY DAUGHTREY FOR A CHANGE IN
ZONING FROM A ONE -FAMILY DWELLING DISTRICT NO.2 (SF -2) TO
A TWO-FAMILY DWELLING DISTRICT (217) IN THE WILLOWCREST
#2 ADDITION, BLOCK A, LOT 7, LOCATED AT 1315 N.E. 26TH STREET
(LCAD 39756)
WHEREAS, Judy Daughtrey submitted an application requesting the rezoning of a
vacant lot from SF -2 to 2F located at 1315 N.E. 261h Street being more fully described as:
Lot 7, Block A Willowcrest #2 Addition; and
WHEREAS, on December 6, 2021 the Paris Planning and Zoning Commission
conducted a review of the application and received testimony from property owners living
within two hundred (200') feet of the subject property who expressed concern with the
negative impacts on the character of the single family residential neighborhood with the
uses on this one (1) block of 26th Street N.E. with the proposed change on the lot; and
WHEREAS, following the conduct of the hearing by the Planning and Zoning
Commission, a recommendation was approved by the Commission by on a 5-1 vote to
recommend denial of the application; and
WHEREAS, on December 13, 2021 the Paris City Council conducted a public hearing
on the same application to rezone the property from SF -2 to 2F and received the same
testimony from the same individuals objecting to the approval of the request; and
WHEREAS, the City Council then voted unanimously to deny the request and
directed the City Staff to prepare findings of fact consistent with denial of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS, THAT:
Section 1. The findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. The application submitted by Judy Daughtrey requesting the rezoning of
a vacant lot from SF -2 to 2F located at 1315 N.E. 261h Street (LCAD# 39756) be denied
based upon the following findings of fact:
A. The subject property is zoned One Family Dwelling District No. 2 (SF -2), is an
undeveloped lot containing approximately 7,900 square feet, is conforming in lot size for
the SF -2 District, and is surrounded by single family homes.

B. The requested change in zoning from SF -2 to 2F would permit the construction of a two-
family dwelling on this lot surrounded by single-family residences and would result in a
non -cohesive land use pattern along this one (1) block stretch of 26th Street NE and has
the potential to negatively impact the neighborhood character of the immediate
surrounding area.
Section 3. This resolution shall become effective from and after the date of passage
