1986-125-RES WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 85-057 authorize the
RESOLUTION NO. 86-l25
WHEREAS, the City Council of the City of Paris did
heretofore in Resolution No. 85-057 authorize the entering
into of a professional services contract with Black & Veatch
Engineers & Architects to perform professional services in
connection with the project entitled "1985 Wastewater
Treatment Plant Improvements", being Proj ect No. 15-86-21,
which contract was entered into on the 8th day of July,
1985; and,
WHEREAS, Anheuser-Busch, acting by and through
Inc., in conjunction with the City of Paris, did
additional engineering services beyond the scope
professional serv~ces agreement with Black &
Engineers & Architects; and,

WHEREAS, such additional engineering services justifies
an increase in the maximum payment defined as "Guaranteed
Maximum Contract Sum," from $121,338.00 to $130,838.00; and,
WHEREAS, it is right and proper that said professional
services agreement be amended in the form of Addendum Number
One attached hereto as Exhibit No.1; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, acting by and through its City Council, does hereby
authorize the amendment of Professional Services Agreement
with Black & Veatch Engineers & Architects dated July 8,
1985, in the form of Addendum Number One attached hereto as
Exhibit No.1; and,
BE IT FURTHER RESOLVED, That Billy Joe Burnett, Mayor
of the City of Paris, be, and he is hereby authorized and
directed to execute on behalf of the City of Paris Addendum
Number One to Professional Services Agreement with Black &
Veatch Engineers & Architects dated July 8, 1985, in the
form of Addendum Number One attached hereto as Exhibit No.
1.

KNOW ALL HEN BY THESE PRESENTS That this Addendum to
Agreement for Professional Services, made this 8th day of
December, 1986, by and between BLACK & VEATCH ENGINEERS &
ARCHITECTS, acting by and through its resident partner,
C. W. Duncan, P. E., and the CITY OF PARIS, PARIS, TEXAS,
acting by and through its Mayor, Billy Joe Burnett, duly
authorized,
WITNESSETH:
It is hereby mutually agreed by and between BLACK &
VEATCH ENGINEERS AND ARCHITECTS and CITY OF PARIS, PARIS,
TEXAS, that the second paragraph of Article II-Contract Sum
be changed to read as follows:
"
Notwithstanding any other understandings or
agreements between the parties, unless specifically
noted herein, the maximum payment by Owner to Engineer
for the performance of the contract shall not exceed
One Hundred Thirty Thousand Eight Hundred Thirty-Eight
and No/IOO Dollars ($130,838.00) which amount is hereby
defined as "Guaranteed Maximum Contract Sum," "Contract
Sum," or "GMCS". Such amount includes all applicable
sales and/or use taxes."
