18 - Adoption of Redistricting PlanItem No. 18 TO: Mayor, Mayor Pro Tem & City Council FROM: Grayson Path, City Manager SUBJECT: ADOPTION OF REDISTRICTING PLAN FOR THE CITY OF PARIS DATE: January 24, 2022 BACKGROUND: City Council previously hired consultant Robert Bass to guide the City through the redistricting process. City Council had a special meeting on December 1St, at which time Mr. Bass presented the City Council with three different plans for redistricting. City Council again met on January 10th in order to further discuss redistricting. At that meeting, City Council instructed City Staff to publish and post for a public hearing on January 24, 2022, with regard to the City's proposed Redistricting Plan. STATUS OF ISSUE: In order to move forward with the adoption of the Redistricting Plan, it is necessary to conduct a public hearing and approve the Plan. BUDGET: The cost of Mr. Bass' services was $7,750.00 and approved by City Council on April 12, 2021. RECOMMENDATION: Approve the Order Adopting a Redistricting Plan for the City of Paris. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ADOPTING A REDISTRICTING PLAN FOR SEVEN CITY COUNCIL DISTRICTS IN THE CITY OF PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on December 1, 2021 and December 15, 2021, the City Council of the City of Paris, Texas convened in special meetings to receive information about the 2020 Federal Census Data and how it would impact the seven single member Council Districts in the City; and, WHEREAS, the City Council has commissioned and has received an Initial Assessment by qualified professionals experienced in the field of redistricting law for the purpose of making a preliminary determination of population distribution between the seven City Council Districts, and the obligation to comply with "one -person -one -vote" balance as required by applicable state and federal law; and, WHEREAS, the initial assessment was adopted by the City council in Resolution No. 2021-044 on December 1, 2021, and is also incorporated by reference hereto as Exhibit 1. WHEREAS, a finding, based upon this assessment, recognized the legal duty to redraw political boundaries to comply with applicable law, and a copy of these Findings of Fact and Order Calling for the Redistricting of Political Boundaries was adopted in Resolution No. 2021-044 and attached hereto and incorporated herein as Exhibit 2; and WHEREAS, by Resolution No. 2021-043, adopted by the City Council of the City of Paris on December 1, 2021, the City Council adopted Criteria for Considering and Adopting a redistricting plan for the City, a copy of this Resolution being attached hereto as Exhibit 3; and, WHEREAS, after convening a Public Hearing for comment upon any and all proposed redistricting plans, and after meeting in open session for the purpose of considering alternatives available to the City for the modification of existing political boundaries in a manner designed to achieve both acceptable levels of numerical balance between the City Council Districts and to protect the voting rights of all residents of the City of Paris, Texas, the City Council has determined that they should adopt redistricting Plan B attached hereto and incorporated herein as Exhibit 4. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Redistricting Plan B depicted in the maps and data attached to this Ordinance as Exhibit 4 is hereby approved and adopted by the City Council of the City of Paris, Paris, Texas. Section 3. That this ordinance shall become effective from and after its passage and publication as required by law for all subsequent elections until changed or modified by later Ordinance of the The City Council. The City of Paris, City Council has previously retained the firm of Allison, Bass & McGee, LLP, of Austin, Texas, to conduct an Initial Assessment of existing political boundaries of the City of Paris, following the issuance of census data by the United States Census Bureau. Harris, City Attorney AN ORDER OF THE CITY COUNCIL OF THE CITY OF PARIS ESTABLISHING CRITERIA FOR REDISTRICTING OF POLITICAL BOUNDARIES The city council for the City of Paris, Texas, meeting in a duly scheduled and posted meeting, does hereby adopt the following criteria for use in the redistricting of all City political boundaries. Any plan for the redistricting of the single -member districts from which representative members of the executive body of the City of Paris are elected should, to the maximum extent possible, conform to the following criteria: 1. The plan should ensure that all applicable provisions of the U.S. and Texas Constitutions, the voting Rights Act, and the Texas Election Code are honored. 2. The plan should be drawn in such a manner that the maximum deviation from an ideal size, as determined by dividing the total population of the city by the number of single member districts that compose the City Council of the City of Paris be not more than plus or minus five (S%) percent for any individual single member district, or a total top to bottom deviation (percentage of deviation below and above the ideal size) between the most populated district and the least populated district by not more than a maximum deviation of no more than ten (10%) percent. 3. The plan should address minority representation, and if at all possible, in conformity with constitutional standards, avoid retrogression in the percentage of population and voting age demographics consistent with existing minority representation. 4. The plan should avoid fragmentation and preserve minority communities of interest to the maximum extent possible. These communities of interest should be recognized and retained intact where possible. Only when the overall minority population of the city is sufficiently large to require more than one minority district should minority populations be divided, and only then to the least degree possible. S. The plan should not, however, attempt to unreasonably join geographically remote minority populations into a single precinct unless there are strong and genuine connections between these communities as reflected by common schools, churches, or cultural ties. For example, minority populations in two separate neighborhoods, located miles apart, may not have sufficient links or common political cohesion to justify joining these two minority population centers into a single electoral group. Particularly when dealing with distinct minority groups, such as Black and Hispanic populations, a general assumption that separate minority populations will vote in a "block" may be unsupportable in fact. i. The plan should seek compact and contiguous political boundaries. Physical boundaries of cultural or economic significance, such as rivers, multi-laned control access highways or turnpikes, which tend to divide populations in fundamental ways, should be recognized and where possible, should only serve as necessary to achieve recognized objectives. Communities of interest should be retained intact where possible. To the maximum extent possible, clearly recognized boundaries, such as streets and highways, should be used to facilitate ease of voter identification of boundaries, as well as election administration. 7. Where possible, well-recognized and long used election precinct boundaril should be retained intact (within the limitations imposed by state and feder�.- law) or with as little alteration as possible. 9. Election precincts in the plan should be sized in conformity with state law. F example, in counties that use traditional, hand counted paper ballots, election precinct may contain more than 2000 voters. In jurisdictions wi I voting systems that allow for automated ballot counting, this number may increased to as many as 5000 registered voters. I 9. The plan should afford incumbent office holders with the assurance that they will continue to represent the majority of individuals who elected these incumbents, and all incumbents' residential locations should be retained in their reformed precincts to ensure continuity in leadership during the remaining term of incumbents to the extent possible. 10. The plan should address fundamental and necessary governmental function and to extent possible, ensure that these functions are enhanced rather th impaired. Election administration should not be unduly complex as a result election boundaries. I 11. The plan should attempt to locate polling places in convenient, well-kno locations that are accessible to disabled voters to the maximum exte possible. Public buildings should be utilized to the maximum extent possib as bli polling places. Where necessary, buildings routinely open to the pu el b li such as churches, retail businesses, or private buildings dedicated to pubI activities, can be used as polling places. 12. If the reduction of polling places can be accomplished, without impinging upo voter co•min nvenience and ority voting rights, such reductions can considered. 13. Citizen input should be encouraged, but in order to minimize cost and to ha sufficient information to evaluate such proposals fairly, the city will on I consider proposed plans submitted to the City for evaluation by individu I citizens or groups if the proposed plan is submitted to the City in a common used GIS format, such •' •' >GPX,.MDB, along with maps a demographics data sufficient to address voting rights concerns, The foregoing criteria are deemed to be illustrative, but not exclusive, examples of fundamentally important issues, which should be considered in any redistricting plan.
