BACKGROUND: On August 9, 2021, the City Council approved Ordinance 2021-024 charging
a Charter Review Commission (CRC) with the task of reviewing the City's Charter and making
recommendations for amendments if necessary. After a series of meetings throughout the fall of
2021, on January 10, 2022, the CRC presented its report to Council with its recommendations for
Charter amendments to be submitted to the electorate at a Charter amendment election. At that
same meeting, the consensus of Council was to approve all recommendations save the following:
1. Council rejected the proposal to adopt a mayor at large system and directed that all
references to the mayor at large issue be removed from the items to be submitted to the
electorate (delete proposed amendments in sections 16 and 19 and delete references to
mayor at large from section 17).
2. Council directed that an attendance policy added to the amendments (add policy to section
17).
3. Council directed that there be language added to section 149 related to the charter review
process including direction that it be undertaken at least every 5 years.
STATUS OF ISSUE: I attach two documents hereto. The first document contains only the edits
that Council made at the January 10th meeting. The second contains all proposed amendments to
the Charter as edited by Council. For the edits to section 149, I broke out the desired changes into
a second paragraph and provided options for two of the issues: (1) how the alternates to CRCs are
appointed, and (2) how the meetings are to be scheduled. As to how the alternates are selected,
you can either take nominations and vote or you can have the mayor and mayor pro tem select
them along with the 15th regular member. Regarding setting of dates and times of meetings, rather
than having the CRC select dates and times once constituted, Council may prefer to set tentative
dates and times in advance, subject to amendment by the Commission, so that when you are
contacting potential appointees, you will be able to give them an idea of when the meetings will
take place so that they determine in advance whether they can commit to the endeavor.
For the edits regarding the attendance policy in Section 17, please consider whether the
requirements apply to all meetings or only regularly scheduled meetings. Consider as well whether
an excuse must be obtained prior to the absence. This is likely impractical since most often Council
Members do not have 2 to 3 weeks' notice that they will need to be absent at the next meeting, as
most absences are for illness or emergency. Bear in mind as well that in the event a Council
Member requests an excused absence, granting of the excused absence will require council action.
BUDGET: Simply choosing the proposed amendments has no budget implications.
RECOMMENDATION: Consider and discuss changes to the language in sections 17 and 149,
and approve final language to the proposed amendments. Council will need to do this at this
meeting so that the legal department can draft the ordinance calling a May 7, 2022 election at the
February 14, 2022 meeting.

convicted of a felony, been adjudged to be mentally incompetent by a court, or be
disqualified by reason of any provision of any other section of this Charter or of Chapter
141 of the Texas Election Code. A member of the council shall immediately forfeit his
office if the member ceases to possess any of the qualifications specified in this section
or in any other section of the Charter or while in office, is convicted of a felony, is placed
on felony probation or placed on deferred adjudication for a felony, or is otherwise subject
to any type of court supervision following disposition or resolution of a felony charge.

ARTICLE XII. GENERAL PROVISIONS
Sec. 149 Amending the Charter.—New language to Sec. 149 relating to review
of Charter and appointment of Charter review commission. We have
provided options on two issues.
Sec. 149. Amending the Charter.
Amendments to this Charter may be framed and submitted to the qualified voters of the
city by a Charter commission in the manner provided by law for framing and submitting a
new charter, or may be proposed by a majority vote of the full membership of the city
council, or may be proposed by a petition signed by not fewer than five percent of the
number of qualified voters in conformity with the provisions hereof. When a Charter
amendment petition shall have been filed with the council in conformity with the provisions
of this Charter as to petitions for initiated ordinances, the council shall forthwith provide
by ordinance for submitted such proposed amendment to a vote of the voters. Any
ordinance for submitting a charter amendment to the voters shall provide that the election
shall occur on the next available uniform election date. Not less than 30 days prior to
such election, the city clerk shall provide to the qualified voters of the city, in such
manners, times and places as the council shall direct, information that shall inform the
voters of the purpose and effect of the proposed amendment, including its exact
language. If a proposed amendment to be approved by a majority of the qualified voters
voting thereon it shall then become a part of the Charter. Each amendment shall be
confined to one subject; and when more than one amendment shall be submitted at the
same time, they shall be so submitted as to enable the voters to vote on each amendment
separately.

Explanatory Note: Containing approximately 3,000 words, Article XI is unnecessarily
extensive and largely overstates the current ability of the city council to regulate rates of
utilities, other than those owned by the city. It was not considered feasible to simply
amend the current provisions. As result of this finding, there is proposed a complete
revision of the Article, running to about 900 words, that will still speak effectively to this
important function.
ARTICLE XII. GENERAL PROVISIONS
Sec. 142. Provisions relating to assignment, execution and garnishment.
The property, real and personal, belonging to the city shall not be liable to be sold or
appropriated under any writ of execution or cost bill. The funds belonging to the city, in
the hands of any person, firm or corporation, shall not be liable to garnishment,
attachment, or sequestration; nor shall the city be liable to garnishment on account of any
debt it may owe or funds or property it may have on hand or owing to any person. Neither
the city nor any of its officers or agents shall be required to answer any such writ of
garnishment on any account whatever. The city shall not be obligated to recognize any
assignment of wages or funds by its employees, agents or contractors f,,a;�c ept by coilrt
order or as by lavIv,n
Explanatory Note: As a result of state regulation and court rulings, cities are no longer
entirely exempt from having an employee's salary garnished.
Sec. 149. Amending the Charter.
Amendments to this Charter may be framed and submitted to the qualified voters of the
city by a Charter commission in the manner provided by law for framing and submitting a
new charter, or may be proposed by a majority vote of the full membership of the city
council, or may be proposed by a petition signed by not fewer than five percent of the
number of qualified voters in conformity with the provisions hereof. When a Charter
amendment petition shall have been filed with the council in conformity with the provisions
of this Charter as to petitions for initiated ordinances, the council shall forthwith provide
by ordinance for submitted such proposed amendment to a vote of the voters. Any
ordinance for submitting a charter amendment to the voters shall provide that the election
shall occur on the next available uniform election date. Not less than 30 days prior to
such election, the city clerk shall provide to the qualified voters of the city, in such
manners, times and places as the council shall direct, information that shall inform the
voters of the purpose and effect of the proposed amendment, including its exact
language. If a proposed amendment to be approved by a majority of the qualified voters
voting thereon it shall then become a part of the Charter. Each amendment shall be

confined to one subject; and when more than one amendment shall be submitted at the
same time, they shall be so submitted as to enable the voters to vote on each amendment
separately.

Explanatory Note: The current wordage in this section speaks only to the problem in
the charter of gender -specific references. The proposed language responds to this
problem and further provides an approach to two other specific issues.
CONCLUSIONS AND RECOMMENDATIONS
The CRC feels that the proposed amendments herein will benefit the City of Paris in its
many policy-making and administrative processes in the future. It is, therefore,
recommended that the city council, following its review of this report, place these
proposed amendments on the ballot for voter consideration at the regular election in May,
2022.
It is further recommended that preceding this election, a public information effort be
undertaken to fully acquaint the electorate with the reasons for and the benefits of the
various amendments proposed. The commission stands ready to assist with this effort
upon the city council's request and as appropriate.
The review commission wishes to express its sincere appreciation for the exemplary
support and assistance of City Manager Grayson Path, City Clerk Janice Ellis, City
Attorney Stephanie Harris, and Director of Finance Gene Anderson, as well as a number
of others on the city's staff, all of whom contributed importantly to the commission's
efforts.
It has been an interesting challenge and a distinct honor to serve our community in this
way. We look forward to favorable action on this report and its recommendations by the
commission and, in turn, by the citizens of Paris.
