RESOLUTION NO. 86-094
WHEREAS, the City Council of the City of Paris, did in
Resolution No. 86-078 on August 11, 1986, approve the
advertisement for bids for furnishing plant, labor, mate-
rials and equipment and performing all work required for the
installation of approximately 3200 lineal feet of 12" C-900
water main with appurtenances and connections to existing
main, beginning at Fitzhugh Avenue's (Sti11house Road)
intersection with Clement Road running Northerly with said
Fitzhugh Avenue (Sti11house Road) to Loop 286 N,E.; thence
in a Westerly direction with said Loop 286 N.E. to an
existing casing; thence under Loop 286 N.E. through the
existing casing to an existing 10" main, entitled Fitzhugh,
Sti11house Road, Loop 286 N.E., Pro Rata Water Main Exten-
sion, which bids were received until 10:00 o'clock A,M.,
Wednesday, September 3, 1986; and,
WHEREAS, the best bid for such construction was made by
Mitchell & Miller, Inc., 407 E. Union Bower, Irving, Texas
75061 and it should be awarded the bid for such
construction; and,
WHEREAS, the form of contract for such construction
project is attached hereto as Exhibit A, and such form
should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Bid of Mitchell & Miller, Inc. in the
amount of $49,908.58, is hereby accepted and let conditioned
upon said contractor meeting all of the terms and specifica-
tions included in the bid documents; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, Billy Joe Burnett, be, and he is hereby authorized
and directed to execute on behalf of the City of Paris the
contract for Fitzhugh, Stil1house Road, Loop 286 N.E., Pro
Rata Water Main Extension upon the terms and conditions and
in the form shown in Exhibit A attached hereto, with
Mitchell & Miller, Inc.

WITNESSETH THAT:
WHEREAS, pursuant to the invitation of the Owner, extended through an
officially published "Invitation to Bid", the Contractor did in
accordance therewi th , on the 3rd day of September, 19 86,
file with the Owner a proposal containing an offer which was invitea-
by said notice; and
WHEREAS, the Owner has heretofore determined that said offer was the
lowest and best submitted:
NOW, THEREFORE, IT IS AGREED:
First: That the Contractor shall comply in every way with the
requirements of those certain specifications entitled:
Fitzhugh, Stillhouse Road and Loop 286 N,E, Pro Rata
(Official title of the specifications and a statement of
Water Main Extension
the limits to which they apply)
Second: That in consideration of the faithful compliance with the
terms and conditions of this Agreement the Owner shall pay to the
Contractor at the times and in the manner provided in said
specification the total sum of
Forty-Nine Thousand, Nine Hundred, Eight and 58/100 Dollars
(the basic contract price both in words an figures)
($49,908,58)
which sum is subject, however, to increase or decrease in such
proportion as the quantities named in said proposal are so changed,all
as in said specifications and proposal provided.

Third: That the time of completion is within forty-five (45)

Fourth: That the contract documents which are hereby made a part of
this Agreement by the actual attachment or by this reference thereto

3. The Detailed Plans listed and described in said
specifications, together with those with may be issued as
supplements thereof; and
4, The Proposal of the Contractor, which was submitted on

which is hereto attached and marked "Exhibit A".
IN WITNESS WHEREOF, said Contractor and said Owner have caused this
Agreement to be executed on the day and year first above written.
