BACKGROUND
This application involves three agenda items:
A. Changing the City's Comprehensive Plan Future Land Use Map (FLUM) for the above two
listed parcels from Low Density Residential (LDR) and Retail (R). The proposed change to
the FLUM is to assure that the rezoning of property is in accordance with the City's approved
Comprehensive Plan.
B. Changing one parcel owned by the applicant Tern Property Investments, LLC from
Commercial (C) Zoning District to MF -2.
C. The last step in the three agenda process of approvals is to rezone the vacant property located
at 35 NW 13th to MF -2. The reason for the change is to permit the construction of a third
apartment structure on the adjoining property to the North.
ANALYSIS & FINDINGS
• The changing of the area guided to medium density is consistent with a mix of land uses
in the immediate surrounding area.
• Adequate buffer transition space and improvements will mitigate the impacts upon
surrounding single family land use to the north.
• The proposed improvements and primary access to the property will be oriented toward
Bonham Street thereby further minimizing the impacts on the low density residential
development to the north.
• Higher density housing can be supported by current roadways and utilities in this
immediate area.
• The change in zoning from SF -2 to MF -2 will be consistent with the FLUM, as amended.
• The change in zoning for the developed properties will allow the current use of the
property to become consistent with the zoning.
PUBLIC COMMENT INPUTS
One land owner response was received in opposition to all three of the requested changes. No
one spoke at the P&Z Public Hearing for or against the requested changes.
RECOMMENDATION
The Planning & Zoning Commission recommended approval of these three zoning changes.
Staff recommends approval of the above three zoning changes as set out in agenda items A, B
and C, changing the FLUM from LDR to MDR and both rezoning's from C and SF -2 to MF -I.
