1985-011-RES WHEREAS, the City of Paris did heretofore in Resolution No. 84-049 authorize contracting with Dual
RESOLUTION NO. 85-011
WHEREAS, the City of Paris did heretofore in Resolution
No. 84-049 authorize contracting with Dual Construction,
Inc., for emergency repair and restoration of the Central
Interceptor Sanitary Sewer, City of Paris, Paris, Texas;
and,
WHEREAS, an abnormal amount of rainfall and continued
wet soil conditions have precluded the contractor from
making final repairs to utility cuts which represent a small
dollar amount of the total contract and the final acceptance
of the rest of the project, the beginning of the warranty
period and the continued holding of the retainage would
unduly penalize the contractor which can be corrected by
Change Order No.1, attached hereto as Exhibit A; and,
WHEREAS, such Change Order should be approved; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That Change Order No. 1 to emergency repair and
restoration of the Central Interceptor Sanitary Sewer
contract with Dual Construction, Inc., is hereby approved;
and,
BE IT FURTHER RESOLVED That Joe Graham, Mayor of the
City of Paris, be, and he is hereby authorized and directed
to execute said Change Order.

The fonOwing changes are hereby made to the Contract Documents:
1. This change order does not constitute any change in price(s) to the Contract.
2. The City of Paris accepts this project as completed, with exception of those
items enumerated in Exhibit "A" and hereby sets this date, February 11, 1985,
as the beginning date for all guarantees and warranties.
3. The City of Paris hereby releases all retainage held, except for $5,000 which
the Contractor agrees shall constitute a bond to insure his proper and timely
completion of the items enumerated in Exhibit "A".
4. Except for this $5,000 retainage held to insure completion of the items enumer-
ated in Exhibit "A", the Contractor agrees that in accepting this Change Order
and upon receipt of payment of all other retainage presently held by the City
of Paris, that he has been paid in full for all items of work accepted by the
City of Paris in this Change Order and he further agrees to release the City
of Paris from all claims whatsoever growing out of this accepted work.
Justification:
Hith exception of the items enumerated in Exhibit "A", this project is recom-
mended for acceptance and it is unreasonable to delay the beginning date of
guarantees and warranties for the remainder of the project while waiting for
proper weather in which to complete these items.

1. Correct/repair the asphalt and/or backfill settlement adjacent
to ~1H #19;
2. Correct/repair the asphalt settlement within the west lane of
12th Street in the vicinity of station 159~;
,3. Correct/repair deteriorating asphalt south of Bonham on
S.W. 12th Street;
4. Correct/repair the asphalt settlement in the south lane of
Bonham Street;
5. Correct/repair asphalt pavement on N.W. 12th Street at Houston
Street;
