09 - Private Tax Re-Sale - Block 174-Lot 7Item No. 9 TO: Mayor & City Council FROM: Robert Vine, Assistant City Manager SUBJECT: PRIVATE TAX RE -SALES DATE: April 11, 2022 BACKGROUND: Tracy Pounders with the law firm of Abernathy Roeder Boyd & Hullett PC has arranged for the private sale of one (1) tax delinquent property for the amount of $500.00 to adjoining land owner, Barbara Forrest. STATUS OF ISSUE: Property No. 22191, "CITY OF PARIS, BLOCK 174, LOT 7" (the "Trustee Property") was previously bid off to the City of Paris as Trustee for itself, Lamar County, Paris ISD and Paris Junior College and deeded to "CITY OF PARIS TRUSTEE" by Instrument 2017- 141849, filed with the Lamar County Clerk on March 20, 2017. Adjacent property owner, Barbara Forrest has been maintaining a portion of this property for several years and has petitioned the city to purchase this lot to add her to small back yard. Ms. Forest does not intend to build a residence on this lot. Assistant City Manager, Robert Vine, met with Barbara Forrest in February of this year and walked the property in question. Due to the characteristics of this property, specifically an extra -ordinarily high elevation from the roadway and only being partially cleared of trees and brush, this particular lot presents itself as less attractive than other available lots for the city's 5 in 5 Program. BUDGET: The City will receive its prorated share of the proceeds of sale as required by the Texas Property Tax Code. RECOMMENDATION: Approve Resolution consenting to the Private Re -Sale of one Tax Foreclosed Property to Barbara Forrest as proposed. RESOLUTION NO. A RESOLUTION APPROVING THE PRIVATE RE -SALE OF A SINGLE TRACT OF TAX FORECLOSED PROPERTY (NO. 22191) TO BARBARA FORREST FOR $500.00, AND AUTHORIZING THE MAYOR TO EXECUTE THE DEED. WHEREAS, Property No. 22191, "CITY OF PARIS, BLOCK 174, LOT 7" (the "Trustee Property") was previously bid off to the City of Paris as Trustee for itself, Lamar County, Paris ISD and Paris Junior College and deeded to "CITY OF PARIS TRUSTEE" by Instrument 2017-141849, filed with the Lamar County Clerk on March 20, 2017; and WHEREAS, Texas Property Tax Code Section 34.05(i) provides that the Trustee Property may be sold by private sale in lieu of a public sale under Texas Property Tax Code Section 34.05(c) & (d) with the approval of all taxing units entitled to receive proceeds from the sale, being the City of Paris, Lamar County, Paris ISD and Paris Junior College; and WHEREAS, a single private offer to purchase the Trustee Property has been received by the City of Paris (the "Private Sale"); and WHEREAS, the Trustee Property adjoins Property No. 22189, 1025 Van Zandt, Paris Texas owned by Barbara Forrest; and WHEREAS, City Staff have determined that due to the Trustee Property's dimensions and current condition this Private Sale will not be of detriment to the City's `5 -in -5' Infill Program; NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of Paris, Texas, that: Section 1. The following offer to purchase the following tract of real property is hereby accepted and consent to the Private Sale is hereby given: • LCAD #22191 —'CITY OF PARIS, BLOCK 198, LOT 15' to Barbara Forrest for $500. Section 2. Subject to the Private Sale also being approved by Lamar County, Paris ISD and Paris Junior College, and the receipt of the monies bid for the Trustee Property, the Mayor is hereby authorized to execute a tax deed conveying the Re -Sale Properties to the Purchaser or designee. Any prior approval to re -sell this Trustee Property is hereby withdrawn. Section 3. The proceeds of the Private Sale shall be distributed in accordance with the Texas Property Tax Code and the orders of the District Courts of Lamar County, Texas.
