2022-030 - Non-Binding Resolution Indicating Support for the Proposed Forestbrook Estates Mixed Use Development to be located at 3375 Jefferson RoadRESOLUTION NO. m22-om A NON-BINDING RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS INDICATING SUPPORT FOR THE PROPOSED FORESTBROOK ESTATES MIXED USE DEVELOPMENT TO BE LOCATED AT 3375 JEFFERSON ROAD, PARIS, TEXAS, MAKING OTHER FINDINGS AND PROVISIONS, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the intent of the City Council to promote the general public welfare; and WHEREAS, the City Council has identified a shortage of housing within the city, particularly with respect to single family homes; and WHEREAS, Lone Star Planned Developments, LLC ("Developer") has approached the city about a proposed mixed use development to be called Forestbrook Estates, to be located at and about 3375 Jefferson Road in the City of Paris, Lamar County, Texas; and WHEREAS, the City Council and the Planning and Zoning Commission met in joint session on April 7, 2022 to receive a presentation about said development; and WHEREAS, the plan for said Forestbrook Estates comprises construction of approximately 183 single-family and/or multi -family homes and amenities in the first phase; and WHEREAS, the site plan calls for a thoroughfare road to be constructed through the development in accordance with the city's future thoroughfare plan; and WHEREAS, future phases of the plan call for multifamily housing, a city park, an elementary school, and commercial and mixed uses; and WHEREAS, the Developer, has indicated its willingness to donate land to the city for said city park, and to the Paris Independent School District for construction of said elementary school; and WHEREAS, the City Council finds that the proposed Forestbrook Estates would fill a need in the city and contribute to the overall economic condition, tax base, quality of life, and wellbeing of the residents of the city; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council of the City of Paris, Paris, Texas hereby confirms that it supports the proposed development of Forestbrook Estates to be located at and about 3375 Jefferson Road, Paris, Texas, more fully described in Exhibit A hereto. Section 3. That it is the intent of the City Council to approve appropriate zoning changes as recommended by the city's Department of Planning and Community Development and the Planning and Zoning Commission to facilitate the development. Section 4. That it is the intent of the City Council to consider approval of a site plan in substantial conformance to Exhibit A, which is attached hereto and incorporated herein by reference, subject to all zoning, platting, and other matters required by the Department of Planning and Community Development, the Planning and Zoning Commission and this City Council, such site plan to be processed according to prescribed methods for approval set forth in the city's adopted Comprehensive Plan and Zoning Ordinance No. 1710. Section 5. That it is the intent of the City Council to amend the city's future thoroughfare plan to provide for the connection of Loop 286 to South Collegiate Drive, to follow the proposed thoroughfare to continue west by connecting to South Collegiate Drive south of Love Civic Center. Section 6. That it is the intent of the City Council to participate in the planning, construction and funding of the thoroughfare described herein, which thoroughfare will connect Loop 286 to South Collegiate Drive and consist of four (4) lanes with a landscaped median of twelve (12) or more feet in width, provided horizontal development commences on property south of the thoroughfare of the site master plan within eight (8) months of the passage of this resolution. Section 7. That this Resolution is non-binding, and any approvals mentioned herein and participation by the city in the financing and construction of the aforementioned thoroughfare road is subject to the will of this and future City Councils, available financing, and the laws of the State of Texas with respect to bonded indebtedness.
