RESOLUTION NO. 85-015
WHEREAS, the City Council of the City of Paris, did at
its Special Meeting on August 27, 1984, approve the
advertisement for bids for furnishing all equipment and
labor to rout, clean and seal approximately 112,000 linear
feet of cracks on the primary runway at Cox Field Municipal
Airport, Paris, Texas, and thereafter said job was
advertised for bids beginning December 23, 1984, with bids
being received until 10:00 o'clock A.M., Wednesday, January
9, 1985; and,
WHEREAS, the best bid for such project was made by Fred
Bader Construction Company, 1103 28th Street, Hondo, Texas
78861, and it was awarded the bid for such project at the
Regular Meeting of the City Council on January 14, 1985;
and,
WHEREAS, the form of
attached hereto as Exhibit
approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the bid of Fred Bader Construction Company, for
furnishing all equipment and labor to rout, clean and seal
approximately 112,000 linear feet of cracks on the primary
runway at Cox Field Municipal Airport, Paris, Texas, in the
amount of $0.22 per linear foot, is reflected in the
contract attached hereto as Exhibit A which the Mayor of the
City of Paris, Joe Graham, is hereby authorized and directed
to execute on behalf of the City of Paris.

thereunto duly authorized so to do, Party of the First Part, hereinafter
termed OWNER, and FRED BADER CONSTRUCTION CO. ,
acting by and through, Fred Bader, Jr.
of the City of
Hondo
, County of
Medina
and
State of
Texas
, Party of the Second r:art, hereinafter termed
CONTRACTOR.
WITNESSETH: That for and in consideration of the payments and
agreements hereinafter mentioned, Party of the Second Part (CONTRACTOR)
hereby agrees with Party of the First Part (OWNER) to commence and com-
plete the construction of certain improvements described as follows:
furnish all equipment and labor to rout, clean and seal approximately
112,000 linear feet of cracks on the primary Runway (#35/17) at Cox
Field l1unicipal Airport, Paris, Texas.
and all extra work in connection therewith, under the terms as stated in
the General Conditions of the Agreement and at his (or their) own proper
cost and expense to furnish all the materials, supplies, machinery, equip-
ment, tools, superintendence, labor, insurance and other accessories and
services necessary to complete the said construction, in accordance with
the conditions and prices stated in the Proposal attached hereto, and in
accordance with the Notice to Contractors, General and Special Conditions
of Agreement, Plans and other drawings and printed or written explanatory
matter thereof, and the Specifications and addenda therefor, as prepared

herein entitled the ENGINEER, each of which has been identified by the
CONTRACTOR and ENGINEER, together with CONTRACTOR'S written
Proposal and the General Conditions of the Agreement hereto attached,
all of which are made a pan hereof and collectively evidence and consti-
tute the entire contract.
The CONTRACTOR hereby agrees to commence work within ten (10)
days after the date written notice to do so shall have been given to him,
and to substantially complete the same within calendar working
days after the date of the written notice to commence work, subject to
such extensions of time as are provided by the General and Special
Conditions.
The OWNER agrees to pay the CONTRACTOR in current funds the
price or prices shown in the proposal, which forms a part of this con-
tract, such payments to be subject to the General and Special Conditions
of the contract.
IN WITNESS WHEREOF, the parties to these presents have executed
this Agreement in the year and day first above written.
