1985-035-RES WHEREAS, the City Council of the City of Paris, did at its regular meeting on January 14, 1985, approve
RESOLUTION NO. 85-035
WHEREAS, the City Council of the City of Paris, did at
its regular meeting on January 14, 1985, approve the adver-
tisement for bids for furnishing all plant, labor and
materials, necessary for the complete installation of the
lay-in grid acoustical ceiling systems for the City Hall
Annex project, entitled Ceiling Work, which bids were
received until 10:00 o'clock A.M., Tuesday, April 30, 1985;
and,
WHEREAS, the best bid for such construction was made by
Grady Elmore, d/b/a Elmore Drywall & Acoustics, 1805 17th N.
E. Street Paris, Texas 75460, and he should be awarded the
bid for such construction; and,
WHEREAS, the form of contract for such construction
project is attached hereto as Exhibit A, and such form
should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Bid of Grady Elmore, d/b/a Elmore Drywall &
Acoustics in the amount of $7,837.50, is hereby accepted and
let; and,
BE IT FURTHER RESOLVED, That the Mayor Pro Tem of the
City of Paris, George Fisher, be, and he is hereby
authorized and directed to execute on behalf of the City of
Paris the contract for Ceiling Work, City Hall Annex
project, upon the terms and conditions and in the form shown
in Exhibit A attached hereto, with Grady Elmore, d/b/a
Elmore Drywall & Acoustics.

AGREEMENT BETWEEN THE OWNER AND THE CONTRACTOR

THIS AGREEMENT, made the 2nd
Nineteen Hundred and Eighty -five
day of May ln the year
(1982), by and between
THE CITY OF PARIS
hereinafter called the OWNER, and
GRADY ELMORE d/b/a ELMORE DRYWALL & ACOUSTICS
hereinafter called the CONTRACTOR.
WITNESSETH, tbat the Owner and the Contractor for the considerstions hereinafter
named agree as follows:
ARTICLE I: THE WORK
The Contractor agrees to furnish all necessary labor, materials, tools and equipment
to complete the Ceiling Work as delineated in the Contract Documents prepared by the
Architect.
ARTICLE II: THE ARCHITECT
The Architect for this project is Denney Architects of Paris, Texas.
ARTICLE Ill: THE CONTRACT SUM
The Owner shall pay the Contractor for the performance of the Work subject to
additions and deductions by Change Order, the Contract Sum of
SEVEN THOUSAND, EIGHT HUNDRED, THIRTY-SEVEN AND 50/100 DOLLARS

ARTICLE IV: PAYMENTS
Based upon Applications for Payment submitted to the Architect by the Contractor and
Certificates for Payment issued by the Architect, the Owner shall make payments on
account of the Contract Sum to the Contractor as outlined in the Summary of the
Work.
ARTICLE V: THE CONTRACT DOCUMENTS
The Contract Documnets shali consist of:

'These form the Contract and all are as fully a part of the Contract as if attached
to this Agreement or repeated herein.
ARTICLE VI: TIME OF COMMENCEMENT AND COMPLETION
The Work to be performed under this Contract shall be commenced upon receipt of a
Notice to Proceed and completed in a prompt and expeditious manner.
THE CONTRACTOR AND THE OWNER for themselves, their successors, executors,
administrators, and assigns hereby agree to the full performance of the covenants
herein contained.
IN WITNESS WHEREOF they have executed this Agreement the day and year first written
above.
