BACKGROUND & DISCUSSION
Over the past year staff has been undertaking a parallel project to the vacant residential registration
requirements; and a new rental licensing program for every residential rental property in all
Historic Districts. This initially developed in response to concerns that were brought to, staff's
attention regarding neglect and other nuisances inside and around the yards of occupied rental
properties and in the South Church Historic District 2. Accordingly, a project team was assembled
including staff from the Community Development, Engineering, Fire and City Administration
Departments. On March 9, 2022 the staff team made a presentation to the Historic Preservation
Commission (HPC). The HPC sent a unanimous recommendation to the City Council for adoption
of the ordinance changes and implementation of the new rental housing inspection program and
vacant residential structure ordinance amendments. There were also several residents in
attendance who spoke in support of the proposed changes to the Historic District Overlay
regulations. Their primary reasons for support was to further protect and enhance the overall
quality of residential properties located within all HPC Overlay Districts 1-16, including those
added in the future.
The attached draft ordinance provides for a licensed registration requirement, including inspection
of the property every 2 years for all residential dwelling units in HPC 1-16. It also imposes
limitations on how many people can occupy a dwelling based upon the square footage of sleeping
quarters in a residential dwelling according to the 2022 International Property Maintenance Code
(IPMC) which is also adopted for these regulations within the Historic Overlay District. It will not,
however, apply to the entire City Limits at this time. Most importantly, it provides for the bare
minimum life safeft requirements to be met as a part of the new bi-annual inspection program.

This will serve both our rental property owners and tenants in assuring the safety of the dwellings
occupied in these historic district properties.
An example has been attached with a standardized inspection checklist which shows all the items
that an inspector will review and inspect for during each visit. Advanced appointments would be
scheduled for rental properties with the landlord owners, or their representatives. The land owner
would in turn notify all tenants in their rental properties in advance of each inspection date
according to standard property tenant notification provisions under law. Staff has also worked to
develop a list of potential rental properties within all the historic districts as a means for initiating
the first rental licensing application procedures for rental properties. At total of 55- properties were
identified in an initial study of potential rental properties within the district. An introductory letter
would be mailed out upon approval of the new requirement once approved by the City Council.
Again, this would apply only to the Historic Districts in the City and not for the entire City
incorporated jurisdiction. This original draft code amendment was brought to the HPC for initial
review and recommendation due to the role of the Commission in the historic districts of the City.

On _, the Paris City Council, following recommendation from the Paris Historic Preservation
Commission, adopted new rental and vacant property registration program registration requirements
for all residential properties located in designated Historical Districts. The purpose of this new
regulation is to ensure that rental housing units meet minimum safety and health standards by providing
a system for ensuring that both absentee and local landlords correct deficiencies and properly maintain
rental property within the city. This purpose will be achieved by providing a system of organized inspection
of residential rental units in the City's Historic Districts by developing a system to monitor and inspect the
orderly and safe occupancy of residential rental units in these areas.
• Interior inspections will be conducted to ensure the property adheres to regulations designed to
protect the safety and welfare of the tenants. Additional information is provided in the brochure.
• Exterior inspections of the premises including the yard, building, storage buildings, and fences will
be conducted on a biannual basis. Additional information is provided in the brochure.
A non-refundable rental registration fee of $55.00 is assessed for each property and is due in April
of every year. A statement for the rental registration fee will be mailed to you on the first of March or
within 30 days of receiving an initial registration form if you register a property during the year.
In an effort to keep rental property owners and tenants informed about changes to policy or
procedure, or to provide specific inspection information about your property, we are asking owners
to supply an email address on your application.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING CHAPTER 4, "BUILDING REGULATIONS," ARTICLE 4.02,
"CONSTRUCTION CODES AND STANDARDS," ARTICLE 4.03, SECTION
4.03.004, "BUILDING AND STANDARDS COMMISSION ESTABLISHED;
PROCEEDINGS; CIVIL PENALTIES," ARTICLE 4.04, "RESIDENTIAL RENTAL
PROPERTY MAINTENANCE," ARTICLE 4.05, "VACANT BUILDINGS;" AND
AMENDING APPENDIX A, "FEE SCHEDULE," OF THE CODE OF
ORDINANCES OF THE CITY OF PARIS, TEXAS; MAKING OTHER FINDINGS
AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER
CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING
AN EFFECTIVE DATE.
WHEREAS, the City Council has previously adopted Chapter 4, "Building
Regulations," Article 4.02, "Construction Codes and Standards," to the Code of Ordinances,
by which the City the has adopted the 2015 International Building Code, the 2015
International Residential Code, the 2015 International Existing Building Code, the 2015
International Plumbing Code, the 2015 International Mechanical Code, and the 2014
National Electrical Code to provide for safe and orderly development of structures in the city;
and
WHEREAS, the City Council has previously adopted Chapter 4, Article 4.03.004,
"Building and Standards Commision Established; Proceedings; Civil Penalties" to embue the
Building and Standards Commission with certain powers, jurisdiction, and authority; and
WHEREAS, the City Council has also previously adopted Chapter 4, Article 4.04,
"Residential Rental Property Maintenance" to provide for a basic level of safety in residential
rental properties throughout the city; and
WHEREAS, the City Council has previously adopted Chapter 4, Article 4.05, "Vacant
Buildings" to encourage development of precious building stock in the Downtown Historic
Overlay District and to provide a basic level of safety for those buildings; and
WHEREAS, the City Council has previously adopted Appendix A, "Fee Schedule,"
Section A3.004, "Registration of Vacant Building" to provide for a fee for maintaining a vacant
building covered by Article 4.05; and
WHEREAS, the City Council has identified a need for additional regulation of vacant
buildings and residential rental properties in the city's historic overlay districts so as to
better preserve the historic value of those structures as well as to maintain the historic
character of those districts;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby
in all things approved.
Section 2. That Chapter 4, Article 4.02 of the Code of Ordinances of the City of
Paris shall be amended by adding a new Division 9, "Property Maintenance Code," to read as
set forth in full in Exhibit A which is attached hereto and incorporated by reference as if fully
set forth.
Section 3. That Chapter 4, Article 4.02, Section 4.03.004, "Building and Standards
Commission Established; Proceedings; Civil Penalty," Subsection (e), "Authority of
Commission; Civil Penaltly," shall be amended to add Subsection (3) (9) to read as follows:
"Provide notice, conduct public hearings, and issue orders related to residential rental
property maintenance as set forth in Article 4.04, Section 4.04.004."
Section 4. That Chapter 4, Article 4.04, "Residential Rental Property
Maintenance," of the Code of Ordinances of the City of Paris, Texas shall be renamed "Article
4.04 Residential Rentals and Property Maintenance," and shall be amended as set forth in in
full in Exhibit B which is attached hereto and incorporated by reference as if fully set forth
herein.
Section 5. That Chapter 4, Article 4.OS, "Vacant Buildings," of the Code of
Ordinances of the City of Paris, Texas shall be amended as set forth in full in Exhibit C which
is attached hereto and incorporated by reference as if fully set forth herein.
Section 6. That Appendix A, "Fee Schedule," Sec. A3.004, "Registration of Vacant
Building," of the Code of Ordinances of the City of Paris, Texas shall be amended as set forth
in full in Exhibit D which is attached hereto and incorporated by reference as if fully set forth
herein.
Section 7. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other provisions
of the ordinances of the City of Paris not in conflict with the provisions of this ordinance
shall remain in full force and effect.
Section 8. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any
penalty accruing or to accrue, or as affecting any rights of the municipality under any section
or provisions of any ordinance at the time of passage of this ordinance.
Section 9. That it is the intention of the City Council of the City of Paris that this
ordinance and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 10. That this ordinance shall become effective upon publication as
required by law.
