1985-025-RES WHEREAS, the City Council of the City of Paris, did at its regular meeting on March 7, 1985, approve the
RESOLUTION NO. 85-025
WHEREAS, the City Council of the City of Paris, did at
its regular meeting on March 7, 1985, approve the advertise-
ment for bids for furnishing all plant, labor, material and
equipment and performing all work required for the removal
and replacement of three raw sewage pumps and associated
piping, valves, electrical power supply, controls, and
instrumentation at the City's Master Pump Station, entitled
1985 Master Pump Station Rehabilitation Project, which bids
were received until 10:00 o'clock A.M., Wednesday, March 27,
1985; and,
WHEREAS, the best bid for such construction was made by
Heritage Constructors, POBox 5903, Texarkana, Texas 75505
and it should be awarded the bid for such construction; and,
WHEREAS, the form of contract for such construction
project is attached hereto as Exhibit A, and such form
should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Bid of Heritage Constructors in the amount
of $278,000.00, is hereby accepted and let; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, Joe Graham, be, and he is hereby authorized and
directed to execute on behalf of the City of Paris the
contract for 1985 Master Pump Station Rehabilitation
Project, upon the terms and conditions and in the form shown
in Exhibit A attached hereto, with Heritage Constructors.

WITNESSETH:
THAT WHEREAS: in accordance with law, Owner has caused Contract Documents

WREREAS, Contractor, in response to the Invitation To Bid, has submitted
to Owner, in the manner and at the time specified, a sealed Bid in accord-
ance with Instructions To Bidders; and
WREREAS, Owner, in the manner prescribed by law, has publicly opened,
examined, and canvassed the Bids submitted, and has determined Contractor
to be the lowest and best Bidder for the Work and duly awarded to Contrac-
tor a contract therefor, for the sum or sums named in Contractor's Bid.
NOW, THEREFORE, in consideration of the compensation to b~ paid to Con-
tractor and of the mutual agreements herein contained, the parties to
these presents have agreed and -hereby agree, Owner for itself and its
successors, and Contractor for itself, himself, or themselves, and its,
his, or their successors and assigns, and its, his, or their executors
and administrators, as follows:
ARTICLE l. Contractor shall perform all Work, including the assumption
of all obligations, duties, and reponsibilities necessary to the success-
ful completion of the contract and the furnishing of all materials and
equipment required to be incorporated in and form a permanent part of
the Work; tools, equipment, supplies, transportation, facilities, labor,
superintendence, and services required to perform the Work; and Bonds,
insurance, and submittals; all as indicated or specified in the Contract
Documents to be performed or furnished by Contractor for the Work included
in and covered by Owner's official award of this contract to Contractor,
such award being based on the acceptance by Owner of Contractor's Bid,
or part thereof, as follows:
