1985-024-RES WHEREAS, the City Council of the City of Paris, did at its regular meeting on January 14, 1985, approve RESOLUTION NO. 85-024 WHEREAS, the City Council of the City of Paris, did at its regular meeting on January 14, 1985, approve the adver- tisement for bids for furnishing all plant, materials, equipment, tools, scaffolding, rigging, hoisting, labor and transportation necessary for the complete installation of the air conditioning and ventilating systems for the City Hall Annex proj ect, entitled Mechanical Work, which bids were received until 10:00 o'clock A.M., Tuesday, March 26, 1985; and, WHEREAS, the best bid for such construction was made by Paris Air Conditioning Co., 3460 Pine Mill Road, Paris, Texas 75460, and it should be awarded the bid for such construction; and, WHEREAS, the form of contract for such construction project is attached hereto as Exhibit A, and such form should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Bid of Paris Air Conditioning Co., in the amount of $19,687.00, is hereby accepted and let; and, BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, Joe Graham, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the contract for Mechanical Work, City Hall Annex project, upon the terms and conditions and in the form shown in Exhibit A attached hereto, with Paris Air Conditioning Co. WITNESSETH, that the Owner and the Contractor for the considerstions hereinafter named agree as follows: ARTICLE I: THE WORK The Contractor agrees to furnish all necessary labor, materials, tools and equipment to complete the Mechanical Work as delineated in the Contract Documents prepared by the Architect. ARTICLE II: THE ARCHITECT The Architect for this project 1S Denney Architects of Paris, Texas. ARTICLE Ill: THE CONTRACT SUM The Owner shall pay the Contractor for the performance of the Work subject to additions and deductions by Change Order, the Contract Sum of Nineteen Thousand, Six Hundred, Eighty-seven and no/100 Dollars --------------------------------- ($ 19,687.00 ) . ARTICLE IV: PAYMENTS Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the Architect, the Owner shall make payments on account of the Contract Sum to the Contractor as outlined in the Summary of the Work. ARTICLE V: THE CONTRACT DOCUMENTS The Contract Documnets shall consist of: Drawing Sheet A-I, dated Feb. 5, 1985, revised Feb. 20, 1985 Drawing Sheet A-2, dated Feb. 5, 1985, revised Mar. 10, 1985 1 EXHIBIT "A" Drawing Sheet A-3, dated Feb. 5, 1985 Drawing Sheet A-4, dated Mar. 10, 1985 Drawing Sheet A-5, dated Mar. 5, 1985 The Contractor's Proposal The Summary of the Work The General Requirements The Insurance Requirements Any Addenda issued prior to bidding Any Change Orders issued after execution of this Agreement This Agreement These form the Contract and all are as fully a part of the Contract as if attached to this Agreement or repeated herein. ARTICLE VI: TIME OF COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced upon receipt of a Notice to Proceed and completed in a prompt and expeditious manner. THE CONTRACTOR AND THE OWNER for themselves, their successors, executors, administrators, and assigns hereby agree to the full performance of the covenants herein contained.
