1985-044-RES WHEREAS, the City Council of the City of Paris did heretofore on the 10th day of December, 1984, in RESOLUTION NO. 85-044 WHEREAS, the City Council of the City of Paris did heretofore on the 10th day of December, 1984, in Resolution No. 84-088 authorize the contracting with Texas Municipal League Joint Self-Insurance Fund; and, WHEREAS, it has become necessary that said Interlocal Agreement with said fund be amended by Addendum No. 1 and Addendum No.2, attached hereto as Exhibits A and B, respec- tively, which adds Merico, Inc., as an additional insured with regard to activities at the Sewer Treatment Plant located 7 miles North of the city limits of Paris on the East side of U. S. Highway 271 North and adds Merico, Inc., as loss payee as its interest may be shown in the Sewer Treatment Plant located as above stated; and, WHEREAS, the form of said addendums to said Interlocal Agreement are in all things approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That, the City Manager of the City of Paris, David H. Doty, be, and he is hereby authorized and directed to execute on behalf of the City of Paris, Addendum No. 1 and Addendum No. 2 to the lnterlocal Agreement with Texas Municipal League Joint Self-Insurance Fund, being said fund's contract No. C-0088 and bearing effective date of October 1, 1984, such addendums to be in the form of Exhibit A and Exhibit B attached hereto. Haynes, City Attorney CITY OF PARIS ADDITIONAL,INSURED CLAUSE Effective Date: April 16, 1985 Addendum Number: 1 It is agreed that the "PERSONS INSURED" prOV1Slon is amended to include the person or entity named below as an "insured," but only with respect to lia bili ty occasioned by the acti vi ties of the "Named Insured" at the property listed below and only to the extent and amount of coverage limits for which the Fund is contractually obiligated on behalf of the "Named Insured." CITY ,OF PARIS LOSS PAYABLE CLAUSE Effective Date: April 16, 1985 Addendum Number:2 Loss Payee: Merica, Inc. c/o Corporate Risk Management & Insurance Department Anheuser-Busch Companies, Inc. One Busch Place St. Louis, Missouri 63118-1852 Loss or damage under Property Coverage shall be paid as int2rest may appear to the city and loss payee shown in this addendum. This INSURANCE covering the interest of the loss payee shall become invalid only because of the Member's fraudulent acts or omissions. However, the Fund reserves the right to cancel this INSURANCE as permitted by the Interlocal Agreement. Notice of Cancellation mailed to the loss payee at least 30 days prior to the date the coverage for the loss payee will end terminates this Agreement. The INSURANCE covering the loss payee's interest as specified in this loss payable clause will continue for subsequent coverage periods regardless of any coverage expiration date shown on the Interlocal Agreement until the Fund mails Notice of Cancellation to the loss payee at least 30 days prior to the da te the coverage for the loss payee will end. If the Member cancels the coverage as permitted by the Interlocal Agreement the Fund agrees to mail Notice of Cancellation to the loss payee at least 30 days prior to the da te the covera ge for the loss payee will end. In any event, the Member's coverage ends on the date of the cancellation. In the event the Fund pays the loss payee the Fund shall, to the extent of payment, be subrogated to the loss payee's rights of recovery.
