1985-098-RES WHEREAS, the City of Paris has need for professional real estate appraisal in conjunction with the RESOLUTION NO. 85-098 WHEREAS, the City of Paris has need for professional real estate appraisal in conjunction with the acquisition of right-of-way for the Collegiate Drive improvement project between Loop 286 N. E. and Lamar Avenue, and Pat Murphy & Associates has made a proposal for such appraisal service; and, WHEREAS, it is deemed to be in the best interest of the City of Paris that such proposal be accepted and that a Professional Services Contract in the form of Exhibit A attached hereto and made a part hereof should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the proposal of Pat Murphy & Associates for professional real estate appraisal services described in Exhibit A attached hereto, be, and the same is hereby accepted. BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, George Fisher, Jr., be, and he is hereby authorized and directed on behalf of the City of Paris, to execute the Professional Services Contract attached hereto as Exhibit A. Main Street, Suite F, Paris, Texas 75460, acting by and through its proprietor, W. P. "Pat" Murphy, hereinafter referred to as "APPRAISER", do contract and agree as follows: 1. The CITY wishes to procure and the APPRAISER desires to provide professional real estate appraisal services as described in Exhibit A attached hereto and incorporated herein for all legal purposes, for $9,600.00. 2. In the event that CITY needs and desires APPRAISER to testify in court, APPRAISER agrees to so prepare and testify in court at an hourly rate of $50.00 per hour for preparation and testimony time. 3. CITY and APPRAISER each bind itself, its successors, assigns and heirs to this agreement and to the covenants contained herein. APPRAISER shall not assign, sublet, or transfer its interest in the contract without the written consent of CITY. 4. APPRAISER will not discriminate against any employee or applicant for employment because of race, religion, color, sex or national origin. APPRAISER will take affirmative action to insure that applicants are employed and that employees are treated during employment without regard to their race, religion, color, sex or national origin. Such action shall include, but is not limited to the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff, termination; rates of payor other forms of compensation; and selection for training, including apprenticeship. APPRAISER agrees to post, in conspicuous places available to employees and applicants for employment, notices setting forth the requirements of these non-discrimination provisions. 5. Doty City Manager Paris, Texas 75460 Re: The appraisal of 28 parcels in the Collegiate Drive Project, No. MA757(1) in Lamar County, Texas. Dear Mr. Doty: At the request of Mr. T.K. Haynes, I have prepared a proposal to appraise the 28 par""ls in the Collegiate Drive project including the temporary easements when applicable. My estimate is based on the assumption,;that full, narrative reports are not necessary. The appraisals would be based on a physical inspection of the property with the owners invited on the inspection, and include at a minimum; photographs, a brief property description, improvement sketch, highest and best use, comparable sales, a brief summary of the analysis necessary to derive the estimates of value, and a summary of the following values: (1) Whole property before the take (2) Part taken (3) Remainder before the take (4) Remainder after the take (5) Damages or enhancements (6) Total Compensation After a discussion with Mr. John Robinson, Supervisor of the Right of Way Section, Texas State Department of Highways and Public Transportation, I have developed a format that will be sufficiently detailed to meet all of the federal requirements, yet concise and summarized enough to maximize the saving of time and money in the appraisal process. I have assumed that the city will furnish legal descriptions, the name of the owner of record, his address and phone number, 5 year sales history, recording data, and an up to date map of the project. I would anticipate working closely with your staff on any unforseen questions or problems especially pertaining to the descriptions of the whole properties and the 2673 NORTH MAIN STREET. SUITE F . My fee for this assignment will be $9600. The overall time until completion of the project will be no more than sixty days and I will forward the individual appraisals to the staff as they are completed. Partial payment will not be necessary for work completed unless the project is placed on hold or canceled. I would then expect payment for services rendered to that date. I also agree, at your request, to prepare for court testimony and to appear in court in support of my appraised value for a fee of $50 per hour.
