The Board of Adjustment here by approves the variance request based upon the following findings
of fact.
BOARD RECOMMENDED FINDINGS
1. The request for variance is harmony with the general purposes and intent of Zoning
Ordinance No. 1710, as amended, and will not negatively impact the protection for the
adjacent surrounding property.
2. The request is to permit a temporary development sign for a permitted use in the C District
which is not applicable with regard to a non -conforming use.
3. There are special and unique conditions related to the request regarding lot size, narrow road
frontage, safety conditions of Loop Highway pertaining to the development of the site which
support the need for a larger sign for a number of reasons, but principally safety as related to
the permitted size of the sign.
4, The hardship sought to be avoided is not the result of (a) the applicant's own actions (self-
imposed or self-created although unintentional), but rather for safety factors. (b) There is no
economic or financial hardship. The substandard parcel lot depth is a result of the
undeveloped property available for this development.
5. The provisions of Zoning Ordinance No. 1710, and its amendments, that are sought to be
varied would deprive the applicant of the normal rights to use the property that is commonly
enjoyed by other similar sized properties along this entire NE segment of Loop 286 and the
same C Zoning District.
This decision was filed in the Board's office on 7/5/2022.
