for a Master Thoroughfare Plan Amendment from a Minor Arterial Roadway
to a Major Collector Roadway on Fitzhugh Ave., North of Clement Rd to NE
Loop 286.

BACKGROUND
At its meeting held on July 5, 2022, the Planning & Zoning Commission recommended
approval of this City initiated change to the Master Thoroughfare Plan. Staff reviewed the
above segment of the Master Thoroughfare Plan in relation to the new approved DPI
Subdivision at the NW intersection of Fitzhugh Ave and Clement Street NE. The current plan
calls for an Arterial Roadway Classification and the Development Staff Team and P&Z finds
this classification inside the loop to be unrealistic and unnecessary. It also would have
negatively impacted the planned development of the subdivision site now planned for 3
duplexes under the City's 5 In 5 Infill Housing Development Program. Therefore it is
recommended that the roadway functional classification should be reduced to a Major
Collector requiring 60 ft. of ROW width which is consistent with the existing roadway.
RECOMMENDATION
Staff and the P&Z recommends approval of the Minor Amendment to the Master Thoroughfare
Plan from a Minor Arterial Roadway to a Major Collector Roadway on Fitzhugh Ave., North
of Clement Rd to NE Loop 286.
ORDINANCE NO.
AN ORDINANCE OF THE CITY OUNCIL OF THE CITY OF PARIS,
TEXAS, APPROVING A MINOR AMENDMENT TO THE MASTER
THOROUGHFARE PLAN FROM A MINOR ARTERIAL ROADWAY TO
A MAJOR COLLECTOR ROADWAY ON FITZHUGH AVE. NORTH OF
CLEMENT RD. TO NE LOOP 286; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, city staff has reviewed the proposed Master Thoroughfare Plan in
relation to a new approved DPI Subdivision at the northwest intersection of Fitzhugh
Ave. and Clement Rd.; and
WHEREAS, the current plan calls for an Arterial Roadway Classification and
the development staff team believes this classification inside Loop 286 is unrealistic
and unnecessary; and
WHEREAS, it would negatively impact the planned development of the
Subdivision site now planned for three (3) duplexes under the City's 5 in 5 Infill
Housing Development Program; and
WHEREAS, at its July 5, 2022 meeting, after conducting a public hearing, the
Planning and Zoning Commission recommended that the roadway functional
classification should be reduced to a Major Collector requiring a lesser right of way of
60 ft. consistent with the existing roadway right of way width; and
WHEREAS, at the July 25, 2022 meeting of the Paris City Council, the City
Council, after conducting a public hearing, and having considered the
recommendations of the Planning and Zoning Commission and the testimony and
evidence introduced at said public hearing finds and approves the Minor amendment
to the Master Thoroughfare Plan from a Minor Arterial Roadway to a Major Collector
Roadway on Fitzhugh Ave., north of Clement Rd. to NE Loop 286 by a vote of _ yeas
to nays.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are
hereby in all things approved.
Section 2. That a minor amendment to the Master Thoroughfare Plan from a
Minor arterial Roadway to a Major Collector Roadway on Fitzhugh Ave., north of
Clement Rd. to NE Loop 286is hereby approved.
Section 3. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other
provisions of the ordinances of the City of Paris not in conflict with the provisions of
this ordinance shall remain in full force and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected by
the enactment of this ordinance shall not be construed as abandoning any action now
pending under or by virtue of such ordinance or as discontinuing, abating, modifying,
or altering any penalty accruing or to accrue, or as affecting any rights of the
municipality under any section or provisions of any ordinance at the time of passage
of this ordinance.
Section S. That it is the intention of the City Council of the City of Paris that
this ordinance and every provision hereof, shall be considered severable, and the
invalidity or partial invalidity of any section, clause, or provisions of this ordinance
shall not affect the validity of any other portion of this ordinance.
Section 6. That any person violating any provision of this ordinance shall be
guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance
with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and
every day's continuance of any violation of the above -enumerated sections shall
constitute and be deemed a separate offense.
Section 7. This ordinance shall become effective from and after its passage
and publication as required by law.
PASSED AND ADOPTED on this 25th day of July, 2022, by the City Council of
the City of Paris, in regular session, following notice and publication as required by
law..
