Paris for a Master Thoroughfare Plan Amendment from a Major Arterial
Roadway to a Major Collector Roadway on SE 3rd Street/FM 1497 from S
Church Street to County Road 12600,

BACKGROUND
At its meeting held on July 5, 2022 following extensive citizen input, the Planning & Zoning
Commission recommended approval of this City initiated change to the Master Thoroughfare
Plan. Staff has reviewed the above segment of the Master Thoroughfare Plan in relation to a
new proposed Sugg Subdivision along SE 3rd Street recently rezoned by the City for new
duplex construction. The current plan calls for an Arterial Roadway Classification and the
Development Staff Team believes this classification inside and outside the loop to the ETJ is
unrealistic and unnecessary. It also would have negatively impacted the planned development
of the subdivision site now planned for 2 duplexes. Therefore it is recommended that the
roadway functional classification should be reduced to a Major Collector requiring a lesser
ROW of 60 ft. which is consistent with the existing roadway ROW width currently at 70 ft. in
Width.
Staff received numerous calls from citizens along this roadway that received mailed notices
required for this minor amendment to the Comprehensive Plan. A number of Inputs were also
received in opposition to the proposed change. Unfortunately, more detailed information
informing the citizens more thoroughly as to what this change entails in that this will have
absolutely no affect at all to their property was not better explained in easy to understand terms
with the advanced hearing notice. In fact it caused a bit of a stir. However, once explained to
the public at the hearing and to each of the many callers, they fully understood the reason for
the change and all their concerns were eliminated.
RECOMMENDATION
Staff recommends approval of the Minor Amendment to the Master Thoroughfare Plan from a
Major Arterial Roadway to a Major Collector Roadway on SE 3rd Street/FM 1497 from S
Church Street to County Road 12600.

AN ORDINANCE OF THE CITY OUNCIL OF THE CITY OF PARIS,
TEXAS, APPROVING A MINOR AMENDMENT TO THE MASTER
THOROUGHFARE PLAN FROM A MAJOR ARTERIAL ROADWAY TO
A MAJOR COLLECTOR ROADWAY ON SE 3RD STREET/FM 1497
FROM S. CHURCH STREET TO COUNTY ROAD 12600; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT;
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, city staff has reviewed the proposed Master Thoroughfare Plan in
relation to a new proposed subdivision along SE 3rd Street recently rezoned by the
City for new duplex construction; and
WHEREAS, the proposed collector street negatively impacts a planned
development of this site; and
WHEREAS, the current plan calls for an Arterial Roadway Classification and
the development staff team believes this classification inside and outside Loop 286
to the ETJ is unrealistic and unnecessary and would negatively impact the planned
development of the planned two (2) duplexes; and
WHEREAS, at its July 5, 2022 meeting, after conducting a public hearing, the
Planning and Zoning Commission recommended roadway functional classification for
the Arterial Roadway should be reduced to a Major Collector Roadway requiring a
lesser right of way of 60 ft. consistent with existing roadway right of way width
currently at 70ft. in width; and
WHEREAS, at the July 25, 2022 meeting of the Paris City Council, the City
Council, after conducting a public hearing, and having considered the
recommendations of the Planning and Zoning Commission and the testimony and
evidence introduced at said public hearing approved the Minor Amendment to the
Master Thoroughfare Plan from a Major Arterial Roadway to a Major Collector
Roadway on SE 3rd Street/FM 1497 from S. Church street to County Road 12600 by a
vote of yeas and nays;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are
hereby in all things approved.
Section 2. That Minor Amendment to the Master Thoroughfare Plan from a
Major Arterial Roadway to a Major Collector Roadway on SE 3rd Street/FM 1497 from
S. Church Street to County Road 12600 be approved.
Section 3. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other

this ordinance shall remain in full force and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected by
the enactment of this ordinance shall

or altering any penalty accruing or to accrue, or as affecting any rights of the
municipality under any section or provisions of any ordinance at the time of passage
of this ordinance.
Section S. That it is the intention of the City Council of the City of Paris that
this ordinance and every provision hereof, shall be considered severable, and the
invalidity or partial invalidity of any section, clause, or provisions of this ordinance
shall not affect the validity of any other portion of this ordinance.
Section 6. That any person violating any provision of this ordinance shall be
guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance
with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and
every day's continuance of any violation of the above -enumerated sections shall
constitute and be deemed a separate offense.
Section 7® This ordinance shall become effective from and after its passage
and publication as required by law.
PASSED AND ADOPTED on this 25th day of July, 2022, by the City Council of
the City of Paris, in regular session, following notice and publication as required by
Law.
